The government has taken a number of measures to strengthen legislation and protections for victims of domestic abuse.

This includes the measures set out in the Domestic Abuse Act 2021, which is helping transform our response to victims and bring perpetrators to justice.

Controlling or Coercive Behaviour within an intimate or family relationship was made a criminal offence under the Serious Crime Act 2015. The Domestic Abuse Act 2021 removed the requirement for the parties to be ‘living together’ for the offence to occur, meaning it applies to intimate partners, ex-partners or family members, regardless of whether the victim and perpetrator live together.

The Domestic Abuse statutory guidance contains detailed sections setting out specifically how victims from ethnic minority backgrounds may experience additional barriers to identifying, disclosing, seeking help or reporting abuse.

The government continues to offer migrant victims in the UK who have, or last had, permission to be in the UK under the family Immigration Rules to apply for access to the Migrant Victims of Domestic Abuse Concession (MVDAC).

The government will continue to work with the police and criminal justice agencies to ensure the law is used to maximum effect to protect victims of domestic abuse.
"} , "answeringMember" : {"_about" : "http://data.parliament.uk/members/4826", "label" : {"_value" : "Biography information for Laura Farris"} } , "answeringMemberConstituency" : {"_value" : "Newbury"} , "answeringMemberPrinted" : {"_value" : "Laura Farris"} , "dateOfAnswer" : {"_value" : "2024-04-24", "_datatype" : "dateTime"} , "isMinisterialCorrection" : {"_value" : "false", "_datatype" : "boolean"} , "questionFirstAnswered" : [{"_value" : "2024-04-24T16:57:29.78Z", "_datatype" : "dateTime"} ]} , "answeringDeptId" : {"_value" : "1"} , "answeringDeptShortName" : {"_value" : "Home Office"} , "answeringDeptSortName" : {"_value" : "Home Office"} , "date" : {"_value" : "2024-04-15", "_datatype" : "dateTime"} , "hansardHeading" : {"_value" : "Domestic Abuse"} , "houseId" : {"_value" : "1"} , "legislature" : [{"_about" : "http://data.parliament.uk/terms/25259", "prefLabel" : {"_value" : "House of Commons"} } ], "questionText" : "To ask the Secretary of State for the Home Department, what steps he is taking to (a) assess and (b) improve the effectiveness of existing legal measures designed to protect (a) minority ethnic women and (b) all people from domestic abuse.", "registeredInterest" : {"_value" : "false", "_datatype" : "boolean"} , "tablingMember" : {"_about" : "http://data.parliament.uk/members/4638", "label" : {"_value" : "Biography information for Mr Tanmanjeet Singh Dhesi"} } , "tablingMemberConstituency" : {"_value" : "Slough"} , "tablingMemberPrinted" : [{"_value" : "Mr Tanmanjeet Singh Dhesi"} ], "uin" : "21775"} , {"_about" : "http://data.parliament.uk/resources/1676827", "AnsweringBody" : [{"_value" : "Home Office"} ], "answer" : {"_about" : "http://data.parliament.uk/resources/1676827/answer", "answerText" : {"_value" : "

It is important that police officers recognise and understand domestic abuse in all its forms. Post-separation abuse is an established risk factor for homicide. The College of Policing authorised professional practice guidance is clear that officers should offer assistance to victims intending to recover property from a residence to ensure this process is carried out safely.

Domestic abuse training plays a crucial role in police officers’ understanding and response to domestic abuse. The specialist Domestic Abuse Matters programme developed by the College of Policing and domestic abuse charities, has been delivered to the majority of forces to date. The Government is also now funding the rollout of the training to those forces who have yet to undertake it. Domestic abuse is a horrific crime and improving the response to domestic abuse is a key priority. As highlighted in the Tackling Domestic Abuse Plan 2022, we want to make it easier for victims to ask for help and report crimes.

It is important that victims know domestic abuse will be taken seriously. Significant progress has been made by the National Police Chiefs Council and College of Policing since the 2021 HMICFRS report on policing of VAWG, including a Framework standardising a policing focus on prevention, action to pursue perpetrators and help build women’s trust in policing.

To further strengthen the police response to disclosures of domestic abuse, we have committed up to £3.3 million up to 2025 to bolster and encourage the uptake of the Domestic Abuse Matters training in police forces. And VAWG (including domestic abuse) has been added to the Strategic Policing Requirement (SPR), meaning it is set out as a national threat for forces to respond to alongside other threats such as terrorism, serious and organised crime and child sexual abuse.

To make it easier for victims to ask for help in their local communities, we are now piloting the Ask for ANI (Action Needed Immediately) codeword scheme in 18 Jobcentres across the UK. The scheme has been available in participating pharmacies since January 2021. A postcode checker has been published on GOV.UK where victims can check for their nearest Ask for ANI location.
"} , "answeringMember" : {"_about" : "http://data.parliament.uk/members/4816", "label" : {"_value" : "Biography information for Miss Sarah Dines"} } , "answeringMemberConstituency" : {"_value" : "Derbyshire Dales"} , "answeringMemberPrinted" : {"_value" : "Miss Sarah Dines"} , "dateOfAnswer" : {"_value" : "2023-04-25", "_datatype" : "dateTime"} , "isMinisterialCorrection" : {"_value" : "false", "_datatype" : "boolean"} , "questionFirstAnswered" : [{"_value" : "2023-04-25T14:36:10.557Z", "_datatype" : "dateTime"} ]} , "answeringDeptId" : {"_value" : "1"} , "answeringDeptShortName" : {"_value" : "Home Office"} , "answeringDeptSortName" : {"_value" : "Home Office"} , "date" : {"_value" : "2023-04-17", "_datatype" : "dateTime"} , "hansardHeading" : {"_value" : "Domestic Abuse"} , "houseId" : {"_value" : "1"} , "legislature" : [{"_about" : "http://data.parliament.uk/terms/25259", "prefLabel" : {"_value" : "House of Commons"} } ], "questionText" : "To ask the Secretary of State for the Home Department, what steps she is taking to encourage people to report domestic violence against women.", "registeredInterest" : {"_value" : "false", "_datatype" : "boolean"} , "tablingMember" : {"_about" : "http://data.parliament.uk/members/4131", "label" : {"_value" : "Biography information for Jim Shannon"} } , "tablingMemberConstituency" : {"_value" : "Strangford"} , "tablingMemberPrinted" : [{"_value" : "Jim Shannon"} ], "uin" : "180776"} , {"_about" : "http://data.parliament.uk/resources/1610186", "AnsweringBody" : [{"_value" : "Home Office"} ], "answer" : {"_about" : "http://data.parliament.uk/resources/1610186/answer", "answerText" : {"_value" : "

Domestic abuse is a horrific crime and improving the response to domestic abuse is a key priority. That is why we introduced our landmark Domestic Abuse Act 2021 (the Act), which will provide further protections to the millions of people who experience domestic abuse and strengthen measures to bring perpetrators to justice, as well as transform the support we give to victims ensuring they have the protection they deserve.

We expect police to treat all victims of domestic abuse with the sensitivity and compassion they deserve, which plays an important part in encouraging victims and survivors to report. Therefore, to strengthen the police response to domestic abuse and as part of our commitment in the Tackling Domestic Abuse Plan 2022 to support the development and further rollout of the Domestic Abuse Matters training, we have committed up to £3.3 million up to 2025 to bolster and encourage the uptake of this training in forces. We will beprioritising funding for those forces who have yet to undertake the training. As part of this commitment, we are also funding the development of a newmodule of the training that is targeted at officers investigating domestic abuse offences to enable further improvement in police responses to domesticabuse incidents.

The Domestic Violence Disclosure Scheme (DVDS), also known as Clare’s Law enables the police to disclose information to a victim or potential victim of domestic abuse about their partner’s or ex-partner’s previous abusive or violent offending either following a request for information by a victim, potential victim or an associated third party or following the police being in receipt of information requiring a disclosure. We have recently commenced section 77 of the Act which places the guidance which underpins the DVDS into statute and published updated guidance ahead of this. This places a duty on the police to apply the guidance unless there is good reason not to and will strengthen the visibility and consistent operation of the scheme. The guidance also makes clear that safeguarding the victim or potential victim is, at all times, a priority.
"} , "answeringMember" : {"_about" : "http://data.parliament.uk/members/4816", "label" : {"_value" : "Biography information for Miss Sarah Dines"} } , "answeringMemberConstituency" : {"_value" : "Derbyshire Dales"} , "answeringMemberPrinted" : {"_value" : "Miss Sarah Dines"} , "dateOfAnswer" : {"_value" : "2023-04-20", "_datatype" : "dateTime"} , "isMinisterialCorrection" : {"_value" : "false", "_datatype" : "boolean"} , "questionFirstAnswered" : [{"_value" : "2023-04-20T09:10:56.14Z", "_datatype" : "dateTime"} ]} , "answeringDeptId" : {"_value" : "1"} , "answeringDeptShortName" : {"_value" : "Home Office"} , "answeringDeptSortName" : {"_value" : "Home Office"} , "date" : {"_value" : "2023-04-14", "_datatype" : "dateTime"} , "hansardHeading" : {"_value" : "Domestic Abuse"} , "houseId" : {"_value" : "1"} , "legislature" : [{"_about" : "http://data.parliament.uk/terms/25259", "prefLabel" : {"_value" : "House of Commons"} } ], "questionText" : "To ask the Secretary of State for the Home Department, what steps her Department is taking to ensure that survivors of domestic abuse are supported to report that abuse to the police.", "registeredInterest" : {"_value" : "false", "_datatype" : "boolean"} , "tablingMember" : {"_about" : "http://data.parliament.uk/members/4812", "label" : {"_value" : "Biography information for Dean Russell"} } , "tablingMemberConstituency" : {"_value" : "Watford"} , "tablingMemberPrinted" : [{"_value" : "Dean Russell"} ], "uin" : "180319"} , {"_about" : "http://data.parliament.uk/resources/1606111", "AnsweringBody" : [{"_value" : "Home Office"} ], "answer" : {"_about" : "http://data.parliament.uk/resources/1606111/answer", "answerText" : {"_value" : "

Tackling violence against women and girls is a government priority. We are committed to supporting victims of abuse, regardless of their immigration status.

The Home Office is grateful to the Domestic Abuse Commissioner for publishing the ‘Safety Before Status: The Solutions’ report and to the Commissioner’s team and external partners for researching the vital issue of support for migrant victims and survivors of domestic abuse.

We will continue to engage with the Commissioner’s office on recommendations set out in the report, and across government. We have already begun to take forward work that stems from some of the recommendations.

We are giving detailed consideration to the findings of this research in conjunction with the external evaluation of the Home Office funded Support for Migrant Victims Scheme pilot (SMV) and considering the wider policies affecting migrant victims and survivors of domestic abuse. Our official response will be published as soon as is practicable. In the meantime, we continue to provide £1.4 million per annum to fund support for all migrant victims of domestic abuse.
"} , "answeringMember" : {"_about" : "http://data.parliament.uk/members/4888", "label" : {"_value" : "Biography information for Lord Sharpe of Epsom"} } , "answeringMemberPrinted" : {"_value" : "Lord Sharpe of Epsom"} , "dateOfAnswer" : {"_value" : "2023-04-04", "_datatype" : "dateTime"} , "groupedQuestionUIN" : {"_value" : "HL6673"} , "isMinisterialCorrection" : {"_value" : "false", "_datatype" : "boolean"} , "questionFirstAnswered" : [{"_value" : "2023-04-04T11:40:16.753Z", "_datatype" : "dateTime"} ]} , "answeringDeptId" : {"_value" : "1"} , "answeringDeptShortName" : {"_value" : "Home Office"} , "answeringDeptSortName" : {"_value" : "Home Office"} , "date" : {"_value" : "2023-03-21", "_datatype" : "dateTime"} , "hansardHeading" : {"_value" : "Domestic Abuse"} , "houseId" : {"_value" : "2"} , "legislature" : [{"_about" : "http://data.parliament.uk/terms/25277", "prefLabel" : {"_value" : "House of Lords"} } ], "questionText" : "To ask His Majesty's Government when they plan to publish their response to the Domestic Abuse Commissioner’s report Safety before status: the solutions, which was due in February.", "registeredInterest" : {"_value" : "false", "_datatype" : "boolean"} , "tablingMember" : {"_about" : "http://data.parliament.uk/members/4540", "label" : {"_value" : "Biography information for The Lord Bishop of Gloucester"} } , "tablingMemberPrinted" : [{"_value" : "The Lord Bishop of Gloucester"} ], "uin" : "HL6672"} ], "itemsPerPage" : 10, "next" : "http://eldaddp.azurewebsites.net/answeredquestions.text?_page=1&AnsweringBody.=Home+Office&hansardHeading=Domestic+Abuse", "page" : 0, "startIndex" : 1, "totalResults" : 220, "type" : ["http://purl.org/linked-data/api/vocab#ListEndpoint", "http://purl.org/linked-data/api/vocab#Page"]} }
