The Government recently published a plan for drivers<\/a> which included support for further Lane Rental schemes, which reduce roadworks by incentivising utilities to avoid the busiest roads at the busiest times helping to reduce congestion caused by road works. The Department will be consulting on requiring local authorities with Lane Rental schemes to use at least 50% of any surplus on pothole repairs or resurfacing poor quality roads.<\/p>

There are currently four schemes in operation which publish annual monitoring and evaluations of their own schemes, and which include information relating to the impact of lane rental on works carried out by utility companies. These can be found on Transport for London<\/a>\u2019s and Kent<\/a> County Council\u2019s websites. Surrey<\/a> and West Sussex<\/a> County Councils are yet to publish their evaluations due to the recent implementation. As scheme coverage can vary year on year, these authorities will be best placed to advise on current mileage.<\/p>

Ongoing discussions are now taking place with other local authorities, and I would encourage all Members of Parliament to press their own Local Authorities to implement lane rental schemes.<\/p>

The Department commissioned an independent evaluation of lane rental pilot schemes<\/a>, which was published in 2016. The evaluation estimated that Lane Rental led to 3000 fewer days of congestion on the highways network.<\/p>

We do not collect nor hold information on fines relating to overrunning works carried out by utility companies. This is held by highway authorities.<\/p>

The Department is to consult on requiring local authorities with Lane Rental schemes to use at least 50% of any surplus on pothole repairs or resurfacing poor quality roads and encourages all local transport authorities to get a Lane Rental Scheme if they don\u2019t already.<\/p>

The efficient co-ordination of street and road works is one of the most important aspects of street works legislation. Section 60 of the New Roads and Street Works Act 1991 (NRSWA) sets a duty on utility companies to use their best endeavours to minimise inconvenience to residents when carrying out street works. In 2020 the Department launched the digital service Street Manager<\/a> for highway authorities and utility companies within England to plan and manage street works. To further help utility companies fulfil their duty to co-operate in this process, a substantial update to the code of practice for coordination of street works<\/a> was published earlier this year.<\/p>

<\/p>

An update to the \u2018Specification of the reinstatement of openings in highways\u2019<\/a> (SROH) was also published in 2020, outlining the standards for reinstating streets after completing street works. Utility companies must reinstate the street once the work is finished, in-line with these standards. We introduced new regulations in April 2023 that introduced performance-based inspections of reinstatement to improve quality and compliance.<\/p>

The Department for Transport is currently considering responses to a recent consultation on amending street works permit conditions relating to portable traffic signals and pavement working. We are encouraging the minority of authorities that have not yet moved to a permit scheme to do so as these are a more effective way of planning and managing street works. In 2018, the Government announced that authorities outside London and Kent, where pioneer schemes already existed, would also now have the option of operating a street works lane rental scheme to manage the impact of works on their busiest roads at busy times.<\/p>

<\/p>

The Government has invested £10m in Street Manager, a new digital system for planning and coordinating street works, which will be used nationwide from April 2020. The Department is currently updating the technical guidance document, \u201cSpecification for the Reinstatement of Openings in Highways\u201d, to bring it up to date and support innovation in the sector. Finally, the Department is starting to consider improvements to the street works inspection regime.<\/p>

A range of legislation, statutory and other guidance applies to utility companies who carry out street works on the local road network to install, maintain and repair the infrastructure on which we all rely. These works are vital but that does not mean they should take longer than they should.
