The Crown Prosecution Service (CPS) collects information to show the number of defendants prosecuted for offences relating to forced marriages identified by way of a monitoring flag applied to the case record. The flag is applied where any offence of threatening behaviour, violence or abuse has been carried out in the context of a forced marriage. During the financial year 2014-15 the CPS prosecuted 45 defendants in England and 46 defendants nationally (England and Wales) for offences associated with forced marriages. CPS figures in relation to the financial year 2015-16 will be placed in the House of Commons Library later this year.

A specific offence of forced marriage was created by section 121 of the Anti-Social Behaviour, Crime and Policing Act 2014 and came into force in June 2014. This offence applies to a person who intentionally forces a person to enter into marriage, believing the person does not consent, or a person who deceives someone into going abroad for the specific purpose of forcing them to marry. During 2014-15, the CPS commenced one prosecution in relation to forced marriage and two in relation to breaches of forced marriage protection orders.
"} , "answeringMember" : {"_about" : "http://data.parliament.uk/members/1560", "label" : {"_value" : "Biography information for Sir Jeremy Wright"} } , "answeringMemberConstituency" : {"_value" : "Kenilworth and Southam"} , "answeringMemberPrinted" : {"_value" : "Jeremy Wright"} , "dateOfAnswer" : {"_value" : "2016-05-10", "_datatype" : "dateTime"} , "isMinisterialCorrection" : {"_value" : "false", "_datatype" : "boolean"} , "questionFirstAnswered" : [{"_value" : "2016-05-10T15:59:48.003Z", "_datatype" : "dateTime"} ]} , "answeringDeptId" : {"_value" : "88"} , "answeringDeptShortName" : {"_value" : "Attorney General"} , "answeringDeptSortName" : {"_value" : "Attorney General"} , "date" : {"_value" : "2016-05-03", "_datatype" : "dateTime"} , "hansardHeading" : {"_value" : "Forced Marriage: Prosecutions"} , "houseId" : {"_value" : "1"} , "legislature" : [{"_about" : "http://data.parliament.uk/terms/25259", "prefLabel" : {"_value" : "House of Commons"} } ], "questionText" : "To ask the Attorney General, how many people were prosecuted in England for forced marriage in (a) 2014 and (b) 2015.", "registeredInterest" : {"_value" : "false", "_datatype" : "boolean"} , "tablingMember" : {"_about" : "http://data.parliament.uk/members/4409", "label" : {"_value" : "Biography information for Naz Shah"} } , "tablingMemberConstituency" : {"_value" : "Bradford West"} , "tablingMemberPrinted" : [{"_value" : "Naz Shah"} ], "uin" : "36316"} , {"_about" : "http://data.parliament.uk/resources/516553", "AnsweringBody" : [{"_value" : "Attorney General"} ], "answer" : {"_about" : "http://data.parliament.uk/resources/516553/answer", "answerText" : {"_value" : "The Crown Prosecution Service (CPS) has successfully prosecuted 35 cases involving 54 defendants who have returned to the UK and are suspected of having fought in Syria and / or Iraq. There are a wide range of offences that can be used to prosecute such individuals but each case has to be considered individually on its merits and whether an arrest or prosecution can take place will depend on the evidence available. The Crown Prosecution Service (CPS) does not maintain centrally held data on the number of cases delayed as a result of CPS files not being handed over to the defence in time before the start of proceedings. Such information could only be obtained through a manual search of records which would incur disproportionate cost.

The CPS is however committed to reducing unnecessary delays in the magistrates’ court, together with other CJS partners, through the Transforming Summary Justice initiative (TSJ). One of the principles of TSJ is to implement a more effective disclosure process to ensure the streamlining of disclosure to defence practitioners for first hearings.
