Where qualifying victims have exercised their statutory right to make representations about the offender's licence conditions, the exclusion zone set will take into account those representations. In each case, the supervising officer proposes conditions as appropriate and requests these from the appropriate authority, which applies it to the licence on behalf of the Secretary of State. In the case of determinate sentence prisoners, the authority is the prison governor; in the case of indeterminate sentence prisoners, or others whose release is on the direction of the Parole Board, the authority is the Parole Board.</p><p> </p><p>These conditions must be kept under review, and are intended to be flexible to the possible resettlement needs of an offender in the community and any new risks that arise.</p><p> </p><p>An exclusion zone will rarely be absolute, as it is recognised that there may be exceptional reasons why the offender needs to enter the exclusion zone. 	answer	answer is ministerial correction date of answer 29/10/2014 answer text <p /> <p>On arrival in an establishment, the risk a prisoner presents to others and themselves, and their risk of harm from other prisoners will be assessed. Where appropriate, this will include a Cell Sharing Risk Assessment to assess a prisoner’s suitability to share accommodation. The risk assessment will consider information and intelligence from a number of sources, including known gang affiliations and conflicts if appropriate.</p><p> </p><p>In April 2014, NOMS completed the implementation of a nationally networked intelligence system - ‘Mercury’. Through the Mercury system staff are able to access intelligence linked to prisoners where a prisoner has previously been held in custody, on or in advance of a prisoner’s arrival (where a prisoner is being sent from another establishment). In addition where a prisoner has previously been held in custody, the National Offender Management Information System (NOMIS) will hold warnings to alert staff to particular risks and behaviours.</p><p> </p><p>A number of law enforcement agencies, including the police, regularly share information about prisoners to support the identification of risk. This includes prisoners with gang affiliations and conflicts.</p><p> </p><p>To ensure that prisoners are held in safe, decent and secure conditions, the risks to and from prisoners remain constantly under review. C&amp;R is a system of techniques used by a team of three officers as a last resort to bring a violent or unmanageable prisoner under control. Wherever possible staff are instructed to avoid use of force and de-escalate the situation by persuasion or negotiation. If the techniques are applied they are used for as short a time as possible.</p><p> </p><p>All prisons submit a central monthly return providing the number of times force has been used in the prison, and specifically the number of uses of C&amp;R. Living accommodation and communal areas are also to be kept clean and maintained. Tackling violence in prisons is a priority for this Government, and steps are being taken to manage levels of violence within a complex and challenging prison population. We will be issuing new guidance to public sector and contracted prison providers on managing violence early next year.</p><p><strong> </strong></p><p>The recently announced joint national protocol between National Offender Management Service (NOMS), the police and the Crown Prosecution Service (CPS) on the appropriate handling of crimes in prison strengthens existing policy and requirements on the reporting of serious assaults or other serious crime occurring in custody so that this type of crime can be targeted. The protocol will be published before the end of the financial year following final consultation.</p><p><strong> </strong></p><p><strong> </strong></p><p>G4S, who manage HMP Altcourse, are preparing an action plan to address any strategic weaknesses, to be overseen by Phil Wheatley, formerly Director General of NOMS. They are in the process of revising HMP Altcourse’s local Incentive and Earned Privilege (IEP), Violence Reduction and Safer Custody strategies. 	answer	answer is ministerial correction date of answer 06/01/2015 answer text <p /> <p>Please see the attached table showing financial penalties for 2013/2014 and quarter 1 of 2014/2015</p><p>It is important to note that performance points are essentially about operational efficiency, and at no point has public safety been at risk.</p><p>The Contract for HMP Altcourse sets out a strict performance framework, consisting of prescriptive performance targets and performance points to be levied against the Contractor for failure to meet prison standards. Performance points are proportionate to the severity of failure and, depending on the total number of points accrued for the performance quarter or year, liquidated damages are applied against the Contractor in accordance with the Contract.</p><p>It is important to stress that the Contractor’s performance is monitored and managed closely by MoJ staff on a daily basis and failure by the Contractor to meet performance targets results in performance points being applied. 	answer	answer is ministerial correction date of answer 09/11/2015 answer text <p>Every self-inflicted death is a tragedy and we are committed to reducing the number of self-inflicted deaths in prisons.</p><p><br> All prisons are required to have procedures in place to identify, manage and support people who are at risk of harm to themselves, and the National Offender Management Service (NOMS) has put in place additional resources to undertake this safer custody work. NOMS is also reviewing the operation of the case management process for prisoners assessed as being at risk and the Government is considering the recommendations of Lord Harris’ Review into the deaths in custody of young adults.</p><p><br> HMP Liverpool is implementing the recommendations arising out of the most recent inspection by Her Majesty’s Inspectorate of Prisons, published on 20 October 2015. The prison has a full safer custody team, which has been allocated additional resources to support prisoners identified as being at risk. It operates a Listener peer support service in partnership with the Samaritans and will shortly be opening an early days centre to improve support for new prisoners.</p><p><br> HMP Altcourse has a local safer custody improvement plan that includes improvements to the support offered to prisoners in their early days. There is much more to do to ensure prisons are places of decency, hope and rehabilitation.</p><p>Violence in prisons has increased in recent years. The nature of offenders currently in custody and the widespread availability of novel psychoactive substances have both contributed to making prisons less safe. There is no single, simple solution to the problems we face but we are making progress.</p><p>We have launched a two year Violence Reduction project to reduce violent incidents and the propensity of violence in prisons. This project will help us to gain a better understanding of the causes and characteristics of violence in prisons and to strengthen the handling of this. We are also trialling the use of body worn cameras in prisons, developing better case management of individuals identified as being at heightened risk of harming others, introducing a psychologically based assessment tool to understand better local factors driving violence in prisons, and training sniffer dogs to detect novel psychoactive substances. We have also made it an offence to smuggle novel psychoactive substances into prison. For this reason, the Services do not recruit personnel with existing medical conditions which may adversely impact on the effectiveness of the Armed Forces, or which may themselves be exacerbated by military circumstances. <br><br>Whilst those diagnosed with autism are excluded from joining the Services on medical grounds, those individuals suffering mild or entirely non-disabling Asperger’s Syndrome may meet the entry standards following an assessment by an occupational health physician and gaining a favourable assessment after pre-entry tests of suitability for military service. <br><br>Recruitment may be permitted for those with ADHD where there is no history of violence or delinquent behaviour, there has been a period of more than three years freedom from symptoms and the candidate has been off all treatment for three years prior to application and is functioning normally.<br><br>The medical entry criteria undergo a rolling programme of revision and that for autism and ADHD have recently been reviewed. 	answer	answer is ministerial correction date of answer 01/02/2016 answer text <p>The Crime Survey for England and Wales estimates that there were 106,000 incidents of race hate crime a year, based on the combined data from the 2012/13 to 2014/15 surveys (the most recently available figures). There has been a clear downward trend in the number of hate crime incidents between the 2007/08 to 2008/09 and 2012/13 to 2014/15 crimes surveys, which have fallen by 28% for all hate crimes over this period. The Home Office also collects information from the police on hate crimes. This shows that were 42,930 race hate crimes recorded by the police in 2014/15, a 15% increase on the previous year. This increase is largely thought to be due to improvements in recording practices by the police over the last year rather than a real increase in race hate crime. However, it is possible in some police forces areas that recording may not be the only reason and there could be an element of real increases in certain areas.</p><p>The Government is committed to tackling all forms of hate crime, including that perceived to be racist by the victim or any other person. That is why we announced in October last year the intention to bring forward a new cross Government hate crime action plan.
