	answer	answer is ministerial correction date of answer 21/11/2014 answer text <p /> <p>This government is committed to tackling domestic violence and abuse and to delivering a better response for the victims of these appalling crimes.</p><p> </p><p>We have ring-fenced £40 million for victims’ services; piloted and rolled out Clare’s Law and domestic violence protection orders; extended the definition of domestic abuse to cover controlling behaviour and teenage relationships; run two successful campaigns to challenge perceptions of abuse; placed Domestic Homicide Reviews on a statutory footing to make sure lessons are learnt from individual tragedies; criminalised forced marriage and consulted on the creation of a single criminal offence of domestic abuse.</p><p> </p><p>The Ministry of Justice Court Proceeding Database holds information on offences provided by the statute under which proceedings are brought but not all the specific circumstances of each case. Data on those proceeded against, found guilty and sentenced for offences involving domestic violence, such as threatening behaviour, violence or abuse between adults are not separately identified in the data reported centrally to the Ministry of Justice. Furthermore, it is not possible to separately identify the relationship between defendant and victim, and their gender. They are supported by the independent Judicial Conduct Investigations Office, which keeps a record of disciplinary findings made against Judicial Office Holders. Those records are kept indefinitely, and any disciplinary sanctions taken against Judicial Office Holders are published on the Judicial Conduct Investigations Office website. A subsequent change of gender and/name by a Judicial Office Holder would have no bearing on the retention of disciplinary records. Should a Judicial Office Holder with a published disciplinary sanction against them subsequently change their name, a note would be made to the published sanction which would identify this.</p></li></ol><ol start="2"><li><p>In relation to prison officers, processes are available to support the changing of an individual’s name and other characteristics within departmental HR records. A number of life sentence prisoners commit offences in prison which result in a second life sentence, as is the case with the offender identified in response to this question. Some life sentence prisoners can also receive a second life sentence on conviction for offences committed prior to being imprisoned (e.g. a previous murder or rape).</p><p> </p><p>Of all offenders sentenced to life imprisonment between the years 2000 and 2013, the offender with the highest number of life sentences imposed on separate sentencing occasions in the 30 years prior to their most recent life sentence is an offender with four life sentences. All of the offender's life sentences were imposed for the attempted murder of fellow inmates and a guard.</p><p> </p><p>The figure provided has been drawn from an extract of the Police National Computer (PNC) data held by the Department. The PNC holds details of all convictions and cautions given for recordable offences committed in England and Wales. Full criminal histories are only available for offenders convicted or cautioned for a recordable offence from the year 2000 onwards. It is available only to those offenders on licence who are not assessed as presenting a high risk of harm to the public. Offenders who are assessed as presenting a high risk of harm are not eligible to receive a fixed-term recall and will be given a standard recall, under which they can remain in custody, potentially, until the end of their sentence. They will be released before the end of their sentence only if the Parole Board or Secretary of State is satisfied they no longer need to be detained to protect the public.</p><p> </p><p>The statutory provisions for fixed-term recalls were included in the Criminal Justice and Immigration Act 2008 and commenced in July 2008. The provisions were amended by the Legal Aid, Sentencing and Punishment of Offenders Act 2012 and commenced in December 2012. The amendments were designed to provide offender managers with additional flexibility to determine whether a fixed-term recall was the appropriate way to respond to an offender’s breach of his licence conditions, notwithstanding that he had been given a fixed-term recall on a previous occasion.</p><p> </p><p>This Government is introducing a new test, in the Criminal Justice and Courts Bill, which must be applied to determine the type of recall given to an offender and to decide whether to re-release a recalled offender. The new test will ensure that any offender who has abused a fixed-term recall previously and persistently and wilfully refused to comply with his licence conditions will not receive a further fixed-term recall. The test will guide offender managers, so that all relevant considerations are taken into account before a decision is taken on the type of recall appropriate to deal with the breach of licence conditions. 	answer	answer is ministerial correction date of answer 09/03/2015 answer text <p /> <p>Absconds and escapes have reached record lows under this Government and temporary release (ROTL) failures have dropped over the past 12 months during which we have taken significant steps to strengthen the ROTL regime. Between July and September 2014 (the latest period for which data are available), there were a total of 61 recorded temporary release failures, 33% lower than the same quarter in 2013. In April-June 2014, there were 40% fewer failures compared to the previous year.</p><p>The table attached shows the number of prisoners with a principal offence of violence against the person who were in open prisons on 30 May 2014 and who had previously absconded, escaped or breached temporary release conditions, broken down by offence. The data in the table is derived from a one-off exercise to look in detail at those prisoners who were in open conditions on 30 May, which was conducted as part of the review of temporary release. It should be noted that the definition of “open prison” for the purposes of this exercise included some prisons operating both open and closed conditions on the same site to ensure that all prisoners with a previous abscond, escape or serious ROTL failure were identified and assessed. It is therefore possible that a number of prisoners included in the total were actually in closed conditions at the relevant time.</p><p>Temporary release and open conditions can be valuable tools in the resettlement of prisoners in the community but never at the expense of public safety. We conducted a fundamental review of the policy and practice of release on temporary licence (ROTL) after serious failures in 2013. We have already made significant changes, including the introduction in May 2014 of a ban on transfer to open prison or ROTL for any prisoner who escapes, abscond, fails to return from ROTL or commits an offence whilst on ROTL during their current sentence.</p><p>This change in policy for eligibility for open conditions was not applied retrospectively. The duration is limited to what is required to conduct the agreed activity and the majority of releases are measured in hours. The maximum duration for the various types of release on temporary licence is set out in national guidance.</p><p> </p><p>There is provision for offenders selected for the national Community Service Volunteers (CSV) scheme special programme for offenders to be released for up to 4 weeks. The offender must be in or suitable for open conditions and be within three months of their release date. These placements are only granted under strict conditions, and as such, very rarely. In addition to applying all the usual risk and suitability assessments, before authorizing release, the governor must determine that the resettlement benefits outweigh the impact on public confidence of that particular offender being on temporary release for a lengthy period. 	answer	answer is ministerial correction date of answer 01/07/2015 answer text <p /> <p>As at 31 March 2015 in England and Wales, there were 1,049 indeterminate sentenced prisoners in open prisons, of which 511 were serving life sentences and 538 were serving an indeterminate sentence of imprisonment for public protection.</p><p> </p><p>The figures have been drawn from administrative IT systems which, as with any large scale recording system, are subject to possible errors with data entry and processing.</p><p> </p><p>The categorisation and allocation of any offender to open prison is never an automatic progression, with public protection the paramount consideration in the decision-making process. Only prisoners whose risks are assessed as being manageable in conditions of low security will be allocated to an open prison.</p><p> </p><p>The vast majority of indeterminate sentence prisoners will be transferred to open conditions only following a positive recommendation from the independent Parole Board. Where they can show that they have made exceptional progress and where there are no known or documented concerns about their risk of harm or risk of abscond, they may be transferred without a positive recommendation from the Parole Board.</p><p> </p><p>Last year, decisive action was taken to protect the public by changing the policy by which prisoners may be transferred to open conditions. As a result of a comprehensive review, major changes were made to tighten the eligibility for open prisons. 	answer	answer is ministerial correction date of answer 01/07/2015 answer text <p /> <p>As at 31 March 2015, 1.1% of the total prison population that have ethnicity declarations recorded on central systems identified themselves as having Irish Traveller or Gypsy background.
