The Equality Advisory Support Service (<a href="http://www.equalityadvisoryservice.com/" target="_blank">http://www.equalityadvisoryservice.com/</a>) is provided to offer advice to people who may have experienced discrimination in England, Scotland or Wales, and an equivalent service is provided by the Equality Commission for Northern Ireland (<a href="https://www.equalityni.org/Individuals/I-have-a-work-related-problem" target="_blank">https://www.equalityni.org/Individuals/I-have-a-work-related-problem</a>).</p><p>The Home Office has published statutory codes of practice for employers and landlords on how to avoid unlawful discrimination whilst conducting statutory right to work and right rent checks under immigration legislation on GOV.UK. Where an application is refused applicants will be able to contact the EU Settlement Resolution Centre to discuss the outcome of their application. 	answer	answer is ministerial correction date of answer 21/12/2018 answer text <p>It is a matter for individual employers as to whether they wish to pay the EU Settlement Scheme fee on behalf of an employee.</p><p>In terms of employers choosing to reimburse their staff for the cost of applying to the settlement scheme, taxation rules are not a matter for the Home Office. However, HMRC has advised that in situations like these, where an employer pays or reimburses their employees’ application costs, such a payment would be taxable as earnings from their employment and may also attract a National Insurance contributions (NICs) charge. However, employers can also choose to meet the cost of this tax and NICs charge for their employees. 	answer	answer is ministerial correction date of answer 12/11/2018 answer text <p>EU nationals currently have an automatic right to rent by reason of their nationality under section 21 of the Immigration Act 2014. Any changes to this position, including to bring EU nationals within scope of the Immigration Act 2016 powers of eviction, will be considered as part of the design of the new global immigration system to be introduced after the EU-exit implementation period. The powers in the 2016 Act enable landlords to evict an individual where the Home Office has served a notice that they are letting to a disqualified person. The EU Settlement Scheme enables them to do so. They will only need to complete three key steps - prove their identity, show that that they live in the UK, and declare any criminal convictions.</p><p>The EU Settlement Scheme opened on a trial basis at the end of August and the second phase of live testing ended on 21 December. In light of the posi-tive progress, we commenced the wider public implementation of the scheme on 21 January. This will allow us to further test and develop the scheme, which will be fully open by 30 March.</p><p>Over the two private beta test phases, over 30,000 applications have been received and the majority of those individuals have already been successfully processed through the scheme and granted status under it. A smaller propor-tion of cases were held pending further evidence of residence to be submitted from the applicant. Caseworkers are working directly with applicants on these cases.</p><p>We have published two separate reports on the both private beta phases and we have committed to provide further details in due course of the planned phased implementation of the scheme. We will continue to update Parliament as part of that process.
