star this property answer text <p>The right to declare an EU instrument invalid is something that can currently only be done by the Court of Justice of the European Union. In general, the Government considers that it does not make sense to create, for our domestic courts, an entirely new jurisdiction in which they are required to take on this function from the CJEU and consider, for example, questions around whether the relevant EU institution misused its powers or complied with the applicable procedural requirements.</p><p><strong> </strong></p><p>However, we recognise, for example, that in some circumstances, individuals and businesses may be individually affected by an EU instrument. For instance, a decision of an EU institution or body may be addressed directly to an individual or business.</p><p><strong> </strong></p><p>This power could be used to enable a right of challenge in domestic law to the validity of retained EU law in such circumstances. This could include provision enabling a challenge which would have been against an EU institution to proceed against a relevant UK public authority instead.</p><p><strong> </strong></p><p>We want to take the time to get this right and we will consider carefully the circumstances where it would be appropriate to enable challenges to be available in domestic law, and the best way of enabling those challenges to proceed. The Government is not planning to publish any draft regulations at Report Stage, but we are keen to listen to and take into account the views of Parliament on this important issue.</p>

star this property answer text <p>The United Kingdom has a residence based health care system, and entitlement to free National Health Service care is largely based on being ordinarily resident in the UK, or being otherwise exempt from charge under the NHS (Charges to Overseas Visitors) Regulations 2015, as amended the Charging Regulations.</p><p> </p><p>A person who is not ordinarily resident in the UK (an overseas visitor) is subject to the Charging Regulations, which require providers of NHS relevant services to make and recover charges from overseas visitors unless an exemption category in the Charging Regulations applies. Since April 2015, it is a requirement when making these charges to apply a charge of 150% of the national tariff to those overseas visitors who are resident outside the European Economic Area, including those resident in the Channel Islands.</p> more like this

This follows the normal processes to achieve value for money for the tax-payer, which is required for all government spending on infrastructure projects. star this property answer text <p>The £4.4 billion Priority School Building Programme is rebuilding or refurbishing those school buildings in the very worst condition across the country. There are two phases of the programme covering a total of 537 schools.</p><p>Under the first phase of the programme, building work is being undertaken at 260 schools. Of these, 177 schools have already opened in their new and refurbished buildings. This includes 98 secondary schools in 57 local authorities and all are on existing sites.</p><p>The vast majority of schools within the first phase of the programme will be delivered by the end of 2017, two years earlier than originally planned.</p><p> </p> more like this

star this property answer text <p>We currently offer permanent flexible contracts to ex-prison officers under the HMPS Reserve Scheme which was established in November 2015. Under the HMPS Reserve Scheme, we offer a permanent flexible contract to prison officers who have left voluntarily within the preceding 2 years. These staff will work flexibly to meet the needs of the estate. This helps to support the current operational workforce across the estate and to complement existing methods for meeting the staffing needs of prisons around the country.</p><p> </p><p>HMPS Reserve staff provide a valuable flexible resource for NOMS by supporting prison regimes and as at 30 September 2016, the date of the most recent published figures, there were 10 prison officer reserves and they continue to be deployed on an on-going basis across the Service in support of existing staff including after the riot in HMP Birmingham.</p> more like this
