	answer	answer is ministerial correction date of answer 19/09/2017 answer text <p>The Law Officers’ Departments are committed to the benefits that can be brought for the taxpayer in the delivery of Government objectives from interchange and is always looking for opportunities to develop arrangements which further the delivery agenda of the Department.</p><p>It is the policy across the Civil Service that where individuals transfer temporarily between our department and another department they move on a loan basis.</p><p>A temporary move to, or from, an organisation outside the Civil Service is referred to as a Secondment and must be for a minimum of 12 months and normally not exceed two years. It does not use a resource board to approve this form of appointments. Rather, the department’s annual budget for staffing is agreed each year by the GLD Board and formal delegations are made to individual budget holders who then have responsibility for the recruitment and deployment of staff (including temporary staff, where appropriate) within central guidelines. The approval mechanism for consultancy spend at the GLD is not via a resources board although a request for consultancy would need to be accompanied by a business justification. Requests for consultancy staff do require a formal business case within the CPS.</p><p>The Serious Fraud Office (SFO) has not employed any consultants within the past financial year or during the current year. Spend on consultants would require a business case setting out the need for such expenditure to the SFO Finance and HR teams. Requests for temporary staff are agreed when the SFO budget is set at the beginning of the financial year. 	answer	answer is ministerial correction date of answer 01/03/2017 answer text <p>Contracted out is defined as <em>‘the transfer of the provision of services previously performed by in-house personnel to an external organisation under a contract with agreed costs and conditions’.</em></p><p>The Government Legal Department (GLD ) and Attorney General’s Office (AGO)primarily provide legal services to government and while they use external suppliers, including law firms and barristers, to support this legal work, none would fall under the definition of contracted out and therefore no pro bono work has been received as part of such arrangements.</p><p>The (AGO), GLD and HM Crown Prosecution Service Inspectorate (HMCPSI) use third party suppliers to provide human resources, finance, information technology, facilities management and other accommodation services. Some elements of these services may have previously been provided in-house but there has been no significant contracting out of these services since 2010. There are no plans for significant contracting out in 2016-17.</p><p><strong>SFO</strong></p><p>The SFO’s procurement team oversees contract awards at the SFO and has records of 944 contracts awarded since 2010. Some low value contracts which are handled by individual teams may not be captured in these records. To provide a breakdown of the number awarded and cost per year would require data to be gathered manually and therefore incur a disproportionate cost.</p><p>Since 1 April 2015, details of SFO contracts over £10,000 have been published on <a href="https://www.gov.uk/contracts-finder" target="_blank">https://www.gov.uk/contracts-finder</a> .</p><p>The SFO does not undertake or commission pro bono work.</p><p>SFO contracts are not awarded or recorded on a working day basis, and it would incur disproportionate cost to review each contract in order to provide an estimate.</p><p>Crown Prosecution Service:</p><p>Since 2012 the Crown Prosecution Service has shared a purchasing service with the Government Legal Department. The department does not hold complete records of the information and to assemble the material would incur disproportionate cost. All contracts issued since 2015 that permit subcontracting have contained such provisions.</p><p>The Government Legal Department (GLD), Attorney General’s Office (AGO), HM Crown Prosecution Service Inspectorate (HMCPSI) and Crown Prosecution Service (CPS) do not centrally hold this data. To calculate or estimate this would involve a manual check of contracts held and this would incur disproportionate cost.</p><p>For future exercises with an anticipated contract value above £5 million per annum, the CPS will apply the requirements of Procurement Policy Note 04/18 (published 29 November 2018).
