star this property answer text <p>HMRC is not a prosecuting authority. They undertake investigations and work with the UK’s three independent prosecutors (England and Wales - Crown Prosecution Service; Scotland - Crown Office and Procurator Fiscal Service; and Northern Ireland - Public Prosecution Service for NI) to achieve positive charging decisions against individuals, some of whom may hold positions within companies.</p><p> </p><p>In the Criminal Finances Act 2017, the Government introduced a corporate offence for all companies, including financial services firms, who fail to prevent tax evasion. This now gives HMRC the power to take criminal action against firms if they have not put in place reasonable procedures to prevent the facilitation of tax evasion by their employees.</p><p> </p><p> </p> more like this

star this property answer text <p>The government are determined that everyone who is entitled to the National Minimum and National Living Wage (NMW) receives it. Anyone who feels they have been underpaid NMW should contact the Acas helpline on 0300 123 1100. HM Revenue and Customs (HMRC) review all complaints that are referred to them.</p><p> </p><p>There was one successful prosecution for NMW offences in 2017. Prosecution is reserved for the most serious non-compliance. It may cause delays in recovering arrears for workers and does not necessarily guarantee payment. HMRC therefore balances recovering NMW arrears for workers as quickly as possible with robust enforcement of NMW when deciding whether to pursue prosecution. There were four successful prosecutions for NMW offences in 2016.</p><p> </p><p>Other consequences for not complying with paying NMW may include fines of 200% of the underpayment and public naming.</p> more like this

However, multinational companies must pay all taxes due and HM Revenue and Customs do not settle for less. star this property answer text <p>The government is determined that everyone who is entitled to the National Minimum and Living Wage (NMW) receives it.</p><p> </p><p>HMRC does not hold separate data for National Minimum Wage and National Living Wage. As referenced in <a href="https://www.parliament.uk/business/publications/written-questions-answers-statements/written-questions-answers/?page=1&amp;max=20&amp;questiontype=AllQuestions&amp;house=commons%2clords&amp;uin=136268" target="_blank">UIN 136268</a>, the ‘National Living Wage’ is a rate for workers aged 25 and over which was introduced in April 2016.</p><p> </p><p>HMRC always takes action to ensure workers receive what they are entitled to. In 2015/16, 958 employers were identified as paying below the NMW. In 2016/17, 1134 employers were identified as paying below the NMW, of which two were prosecuted for underpayment of NMW.</p><p> </p><p>Breaches of NMW legislation are normally a civil matter, consequences for not complying with paying NMW can include fines of 200% of the arrears and public naming.</p><p> </p><p>Criminal prosecution is reserved for the most serious non-compliance. The most serious NMW breaches and cases that form part of wider criminality will be referred to the Crown Prosecution Service who decide whether to prosecute.</p><p> </p><p> </p>

star this property answer text <p>The government treats the issue of customs duty undervaluation fraud very seriously, and has taken reasonable and appropriate steps to address suspected fraud.</p><p> </p><p>The response to suspected fraud continues to evolve as new information becomes available and through learning from ongoing operations. HMRC’s current approach includes physical pre-clearance checks targeted at high risk traders, including requiring importers to provide security before suspected undervalued goods are released and seizing mis-described goods. In addition trader monitoring is in place to examine supply chains and check documentation, and post-clearance compliance activity includes cross-tax audits to check the credibility of information provided.</p><p> </p><p>The government does not recognise OLAF’s estimate of alleged duty loss.</p> more like this
