	answer	answer is ministerial correction date of answer 11/11/2014 answer text <p /> <p>The Government is absolutely clear that abusive and threatening behaviour online is totally unacceptable.</p><p> </p><p>There is a number of offences which may be committed by those abusing others on social media. Internet communication which is grossly offensive or menacing may fall under section 127 of the Communications Act 2003. Sending indecent, grossly offensive or threatening material to another with the purpose of causing distress or anxiety to a person to whom the material is communicated, including by means of the internet, is also an offence under the Malicious Communications Act 1988.</p><p> </p><p>Internet abuse could also amount to an offence under the Protection from Harassment Act 1997 if its distribution is carried out as part of a ‘course of conduct’ which alarms a person or causes distress. Under section 4 of that Act, it is also an offence to pursue a course of conduct that repeatedly puts someone in fear of violence.</p><p> </p><p>Changes to the law being taken forward in the Criminal Justice and Courts Bill will increase the maximum penalty for offences under the Malicious Communications Act 1988 to 2 years imprisonment, and extend the time within which prosecutions under section 127 of the Communications Act 2003 may be brought, to up to three years, as opposed to the current six month limit.</p><p>These steps will help to ensure that people who commit these awful crimes are prosecuted and properly punished.</p> answering member constituency North West Cambridgeshire answering member printed Mr Shailesh Vara question first answered 11/11/2014 17:59:26 answering member 1496 label Biography information for Shailesh Vara

	answer	answer is ministerial correction date of answer 11/11/2014 answer text <p>The Sexual Offences (Amendment) Act 1992 prohibits the publication of any information that is likely to lead to a person being identified as the victim of an alleged sexual offence, from the point at which the allegation has been made. But this prohibition does not prevent the complainant’s name from being used in court and therefore would not serve to conceal it from the defendant (if it was not already known to him). In exceptional circumstances a court may make a witness anonymity order under sections 86 to 90 of the Coroners and Justice Act 2009. 	answer	answer is ministerial correction date of answer 31/03/2014 answer text <p>The Law Commission published its report on Matrimonial Property, Needs and Agreements on 27 February 2014.</p><p> </p><p>The report focuses on clarifying the law in the areas of financial ‘need' and nuptial agreements and makes 3 broad recommendations:</p><p>1. that written guidance is produced on financial need;</p><p>2. that the feasibility is assessed of producing numerical guidance to help couples to calculate the likely financial outcome of divorce or dissolution; and</p><p>3. that pre-nuptial agreements are made statutorily binding.</p><p> </p><p>The Government is grateful to the Law Commission for their hard work on this complex area of law.</p><p> </p><p>The Government is giving the report careful consideration. An interim response will be published by August 2014 and a full response by February 2015. 	answer	answer is ministerial correction date of answer 07/04/2014 answer text <p> </p><p> </p><p>The Government is committed to ensuring that restorative justice is victim-focused, of a good quality and available at all stages of the criminal justice system across England and Wales.</p><p> </p><p>Restorative justice is a process that can be used at any stage of the criminal justice system, either alongside or as part of a formal out of court disposal or sentence. Restorative justice is potentially available for any offence, provided both the victim and offender consent and have been assessed as suitable by a trained facilitator. The use of restorative justice should not lead to offenders escaping punishment and we expect crimes of a serious nature to continue to be progressed through the courts.</p><p> </p><p>Information about the numbers of victims or offenders who are invited to participate in a restorative justice programme, or take up that offer, is not collated centrally. The independent Sentencing Council is responsible for issuing guidelines which all courts must follow when determining the appropriate sentence in each case, within this maximum penalty. On 3 April, the Council opened a consultation on a new draft guideline for theft offences. The consultation period ends on 26 June 2014 and is open to everyone.
