star this property answer text <p>I neither advised on the content of, nor approved, the letter that was sent by the Crown Prosecution Service to members of the independent Bar about action against cuts to legal aid. I was however aware that the letter was to be sent. </p><p> I have said on more than one occasion that there is no justification for barristers failing to honour their professional obligations to the CPS because there is no dispute with the CPS about the level of prosecution fees. It was perfectly proper for the CPS to send this letter reminding barristers of these obligations.</p> more like this

The Director of Public Prosecutions (DPP) has said that the introduction of anonymity for victims of FGM should be considered to encourage more victims to come forward as, given the very personal nature of the offence, very few do so. However, any change of law on anonymity is a matter for the Ministry of Justice.</p> more like this

star this property answer text <p>The Crown Prosecution Service (CPS) recognises that appropriate support is vital to ensure that victims of female genital mutilation (FGM) are able to give their evidence effectively in court. The CPS legal guidance advises prosecutors that in all cases of FGM they must ensure that the complainant is aware of the special measures that can be applied for at court, and that applications are made in time. For all child witnesses there is a presumption that they will give their evidence in chief by recorded interview and any further evidence by live link unless the court is satisfied that this will not improve the quality of the child's evidence. Adult victims of FGM are also eligible for special measures on the grounds that they are likely to be intimidated witnesses in relation to testifying at court. However it is a matter for the court to grant the application.</p> more like this

The five companies were Kent Pharmaceuticals, Norton Healthcare Ltd, Generics (UK) Ltd, Ranbaxy (UK) Ltd, and Goldshield Group plc. In 2008, a judge ordered the acquittal of all five companies.</p><p>If a company is to be prosecuted, it is usually necessary cases to demonstrate that the controlling minds of a company were knowing participants in the criminality being alleged. This can be difficult to prove, especially in complex cases, and so most SFO prosecutions have been of individuals rather than companies. Other outcomes are also possible. In 2010, BAE Systems plc agreed to make a £29.5 million payment for the benefit of the people of Tanzania, following a settlement with the SFO and the US Department of Justice. Last year, Oxford University Press (owners of Oxford Publishing Ltd) unilaterally offered to contribute £2,000,000 to not-for-profit organisations for teacher training and other educational purposes in sub-Saharan Africa.</p><p> </p>

To ascertain the types and value of individual costs awards made over the last five years would require a review of each case and this would incur disproportionate cost.</p><p>The CPS central financial records indicate that the department was required to pay £772,129.54 in costs awards in 2013-14. It should be noted that the accounts for 2013-14 are not finalised and this figure will be subject to audit and adjustment. star this property answer text <p>There have been no discussions between the Director of Public Prosecutions and the Association of Chief Police Officers (ACPO) about implementing the recommendations in HM Crown Prosecution Service Inspectorate report on the disclosure of medical records and counselling notes. The recommendations of the report were that Crown Prosecution Service (CPS) legal guidance on Rape and Sexual Offences was updated and that CPS Headquarters may wish to liaise with ACPO about such disclosure to develop a national police form for use when the police consult complainants. The guidance was updated on 12 December 2013 and the capture of information in a national police form is being considered as part of the work on digitisation of cases files and has been discussed with ACPO.</p><p> </p> more like this

star this property answer text <p>The Crown Prosecution Service (CPS) has not yet been approached for investigative advice, by any police force, in respect of possible criminal matters arising from the Financial Conduct Authority investigation of Wonga.</p><p>Following the announcement that Wonga would pay £2.6 million in compensation, after sending letters from non-existent law firms to customers in arrears, the CPS Deputy Head of the Specialist Fraud Division contacted the City of London Police, on the 26 June 2014, to enquire whether this matter was being criminally investigated.</p><p>City of London Police are the national police lead for serious fraud investigations. They are currently assessing whether the case merits a criminal investigation and have confirmed that they will refer any request for advice to the CPS Specialist Fraud Division.</p> more like this

star this property answer text <p>The table below shows the proportion of unsuccessful prosecutions due to victim issues in each of the last seven years. The data for 2013-14 is not directly comparable with previous years.</p><p>Victim reasons or issues are defined as non-attendance, retraction or the evidence of the victim does not support the case or come up to proof.</p><p>The CPS is continually striving to improve the quality of data used in both internal and external reports. The recording of the reasons for unsuccessful outcomes was changed in April 2013 leading to enhanced recording of victim issues. It is hoped that this may more accurately reflect the proportion of unsuccessful cases due to victim issues.</p><p>Previously victim reasons may have been recorded as ‘essential legal element missing' or ‘unreliable witnesses'. Following a change to clarify the definitions in 2013-14, The CPS has seen a fall in these reasons (from 13.7% to 4.0% and 2.2% to 1.4% respectively). star this property answer text <p>The table below shows the proportion of unsuccessful prosecutions in rape cases due to victim issues in each of the last seven years.</p><p>The recording of the reasons for unsuccessful outcomes was changed in April 2013 leading to enhanced recording of victim issues. It is hoped that this may more accurately reflect the rape victim issues the CPS is addressing through the National Rape Action Plan published in June 2014. The Plan includes a specific action to conduct research into the reasons behind victim withdrawals to help identify steps to encourage victims to engage with the court process.</p><p>Previously victim reasons may have been recorded as ‘essential legal element missing' or ‘unreliable witnesses'. Following a change to clarify the definitions in 2013-14, the CPS has seen a fall in these reasons (from 4% to 1.5% and 8.1% to 1.3% respectively). star this property answer text <p>The Crown Prosecution Service (CPS) has a comprehensive cost reduction strategy to 2015-16 that is fully aligned to, and supports, CPS priorities and objectives. The strategy will ensure that the department meets the SR2013 savings targets.</p><p>In their annual report for 2013-14 the Inspectorate acknowledged that CPS had improved its performance on serious and complex cases and also highlighted CPS success in hate crime cases and those involving violence against women and girls. The report was largely based on cases completed more than a year ago and more recent data shows performance improvements across the board since then. For example, magistrates' courts are seeing more guilty pleas and fewer cases dropped while the Crown Courts are showing increasing conviction rates – now at 81% across England and Wales. The challenges mentioned in the report are being addressed but they should be seen in the context of an improving prosecution service across the country.</p><p> </p> more like this

star this property answer text <p>In 2013-14, the Crown Prosecution Service (CPS) records indicate that there were 55 charges for the offence of keeping a brothel, contrary to sections 33-36 of the Sexual Offences Act 1956 which reached a first hearing in the magistrates court. This does not indicate the number of individuals prosecuted as a defendant may be charged with more than one offence.</p><p>CPS have no record of any prosecutions in 2013-14 under Section 53A of the Sexual Offences Act 2003, as amended by Section 14 of the Policing and Crime Act 2009, which enables individuals accused of seeking or using the services of a prostitute to be prosecuted.</p><p>To obtain further details of the number of cases in which defendants were alleged to be prostitutes, pimps or brothel keepers, would require a manual review of individual case files which could only be undertaken at a disproportionate cost.</p><p> </p> more like this

star this property answer text <p>Prosecutions for dog-fighting and badger persecution are conducted under the Animal Welfare Act 2006 and Protection of Badgers Act 1992 respectively. The Crown Prosecution Service (CPS) does not maintain a central record of the number or prosecutions for ‘dog fighting’ conducted under the Animal Welfare Act.
