star this property answer text <p>The Department does not collect this information. Statistics collected by the Department show that, in October-December 2020 (the latest period for which data is available) the vast majority of tenants were up to date with their rental payments.</p><p>The Department has been clear throughout the coronavirus pandemic that tenants must continue to pay their rent and has put in place an unprecedented package of support to assist them in doing so. This includes the furlough scheme and boosting the welfare safety net with billions of pounds, preventing widespread rent arrears. .</p><p>Legislation was in place to prevent bailiffs from serving eviction notices and carrying out evictions, except in the most serious circumstances, from 17 November 2020 until 31 May 2021. However, there were exemptions for the most serious circumstances, including serious rent arrears.</p><p>Since 1 June, bailiffs have been permitted to enforce valid warrants of possession. This ensures that landlords can exercise their right to justice and reflects the gradual easing of national restrictions. Bailiffs must provide 14 days' notice of an eviction and have been asked to reschedule the eviction appointment if the tenant has coronavirus symptoms or is self-isolating.</p>

The fund will run for 4-years and help communities protect assets which are locally important and deliver a community benefit</p><p><br> The Government has also taken steps to safeguard local heritage through a campaign to encourage local authorities, working with their communities, to identify locally important historic buildings and assets for inclusion in their local heritage list. £1.5 million of funding has been made available to 22 areas across England to take forward this work.</p> more like this

In addition, they will state if the non-departmental public body has met key performance indicators as set out in their business and corporate plans. The report and accounts are laid in Parliament and, where commercially possible, made available on the non-departmental public body’s website.</p>

star this property answer text <p>The legal provisions described are intended to provide authorities with the power to mitigate, where appropriate, adverse effects arising from development and other actions.</p><p>A local planning authority makes planning decisions based on policies in their Local Plan and other material considerations. The authority is able to seek a planning obligation under section 106 of the Town and Country Act 1990 to mitigate the implications of a specific development, to make it acceptable in planning terms. The authority must meet three legal tests in seeking to apply the section 106 planning obligation: the obligation must be necessary to make the development acceptable in planning terms; it must be directly related to the proposed development; and it must be fairly and reasonably related in scale and kind to the proposed development.</p><p>A section 106 agreement attached to a planning permission can restrict the development or use of the land in any specified way; require specified operations or activities to be carried out in, on, under or over the land; require the land to be used in any specified way; or require a sum or sums to be paid to the authority on a specified date.</p><p>The Greater London Council (General Powers) Act 1974 provides authorities in London with various powers, including regarding traffic management. Section 16 of the Act allows a local authority to enter into an agreement with the owner of land where the agreement is ‘given or made under seal in connection with the land'.</p><p>In our White Paper 'Planning for the Future', published in August last year, we set out a proposal to reform the system of developer contributions, including s106 planning obligations. We are analysing consultation responses thoroughly, and engaging further with authorities and developer organisations, and will be announcing our intentions shortly.</p>

star this property answer text <p>In 2019, the United Kingdom was the first G7 country to put into law our ambition to reach net zero carbon emissions by 2050. Following the Climate Change Committee's recommendation, the Sixth Carbon Budget targets an ambitious and world-leading 78 per cent reduction in emissions between 1990 to 2035.</p><p>The National Planning Policy Framework clearly sets out how planning authorities should support the transition to a changing climate and how to avoid vulnerability of new development to the effects of climate change. Additionally, the Climate Change Planning Practice Guidance sets out further advice on how local planning authorities can integrate adaptation and mitigation policies into their decision-making.</p><p>The <em>Planning for the Future </em>White Paper outlines how the Government will work to improve the planning system to help us meet our net zero targets and bolster environmental standards, and we will reflect very carefully on the views received in considering how best to take its vision forward. The consultation generated enormous interest and we are currently reviewing and analysing these responses and we will set out the proposed way forward.</p><p>Local leadership is important, and we are committed to working closely with local authorities across the United Kingdom, particularly when it comes to reducing our emissions. They are uniquely well positioned to harness local actors to align local needs with national interests, drive clean local growth, and influence behaviour.</p>

star this property answer text <p>The recent rise in antisemitic attacks is completely unacceptable and we condemn it. Antisemitism has absolutely no place in our society, which is why we’re taking a strong lead in tackling it in all its forms.</p><p>Since May, the Secretary of State for Housing, Communities and Local Government has met with Jewish communities affected by the recent increase in hate crime and has met with Lord Mann, the Government’s Independent Adviser on Antisemitism, who is providing independent advice on the most effective methods to tackle antisemitism.</p><p>This Government has an excellent track record of taking action to prevent antisemitism.</p><p>We have provided funding to a number of innovative projects to reinforce messages of tolerance for our young people and teach them about the dangers of hate and we are providing £14 million this year for the Protective Security Grant to protect Jewish schools and community buildings.</p><p> </p><p> </p> more like this

The National Planning Policy Framework clarifies that planning policies and decisions should aim to achieve places which are safe and accessible, so that crime and disorder, and the fear of crime, do not undermine the quality of life or community cohesion – for example through the use of clear and legible pedestrian routes, and high quality public space, which encourage the active and continual use of public areas. <br> <br> The National Design Guide and draft National Model Design Code refer to the recommendations set out in Secured by Design, to ensure new developments create safe environments, including the need to ensure natural surveillance. The Government is currently seeking views on the draft National Model Design Code by 27 March.</p> more like this

star this property answer text <p>We are taking decisive action to improve building safety and prioritising unsafe cladding which is a higher risk and can act as a fire accelerant – and is a greater risk in higher rise blocks. It is right that we prioritise action on higher rise buildings (over 18 metres) where risk to multiple households is greater when fire spreads. 18 metres is the height referenced in building regulations guidance and in all the advice we have issued to building owners since the Grenfell Tower fire. For the purposes of the Building Safety Fund we are allowing a tolerance of 30cm to this measurement so where there is appropriate evidence that a building measures 17.7 metres or above it will be eligible in regard to its height. This is to allow for measurement error, the potential for ground levels to have varied from the original design and the settlement of the building over time.</p> more like this

star this property answer text <p>The Building Safety Fund should not be the only means of funding the remediation of unsafe cladding on high-rise residential buildings. Building owners should meet the costs without passing them on to leaseholders wherever possible, through their own resources or by recovering costs from applicable warranty schemes or from the developers or contractors who were responsible for the installation of unsafe cladding, as is happening with more than half of the private sector buildings with ACM cladding. Applicants to the Building Safety Fund are required to demonstrate that they have taken all reasonable steps to recover the costs of replacing the unsafe cladding from those responsible.</p><p> </p><p>Furthermore, as announced on 10 February 2021, we are going to introduce a developer levy through the Building Safety Bill to be targeted and applied when developers seek permission to develop certain high-rise buildings in England. In addition, we will introduce a new tax for the UK residential property development sector in 2022. The levy and tax will ensure that the largest property developers make a fair contribution to the remediation programme. The Government will consult on the policy design of the tax in due course.</p>

star this property answer text <p>The Secretary of State made an announcement in Parliament on 10 February of a decisive five-point plan to end the cladding scandal once and for all.</p><p>To protect leaseholders, we are providing direct funding for the remediation of unsafe cladding from buildings over 18m in height. This is in line with longstanding expert advice on which buildings are at the highest risk.</p><p>Buildings below 18m will not carry the same inherent risk as a building above 18m, however some will need remediation, so to give residents in lower-rise buildings peace of mind, we are also establishing a generous scheme to ensure, where required, cladding removal can take place on buildings between 11 and 18 metres.</p><p>We are also committed to making sure no leaseholder in these buildings will have to pay more than £50 per month towards this remediation.</p><p>This builds on steps already taken to support leaseholders, including £1.6 billion of funding to remediate unsafe cladding, the £30 million waking watch fund to help end excessive costs and new legislation in the Building Safety Bill which will ensure homes are made and kept safer in future.</p>

The local authority must issue a revised liability notice if the chargeable amount changes, including if there is a change to the exemption. Where an authority issues a liability notice any earlier liability notices cease to have effect.</p><p>The CIL regulations set out an appeal process, under which an applicant has 60 days from the issuance of their CIL liability notice, and prior to the commencement of development, to appeal the chargeable amount. We are not currently seeking to introduce an additional arbitration process to CIL. However, in developing the new Infrastructure Levy, we will carefully consider how best to address any disputes over liabilities.</p>

star this property answer text <p>By September our ongoing ‘Everyone In’ campaign had supported over 29,000 vulnerable people, with over 10,000 in emergency accommodation and nearly 19,000 provided with settled accommodation or move on support. Launched in the summer, the Government’s Next Steps Accommodation Programme makes available the financial resources needed to support local authorities and their partners to prevent those accommodated during the pandemic from returning to the streets. We announced allocations of £91.5 million to local authorities on 17 September to pay for immediate support to ensure that as many people as possible do not return to the streets. On 29 October, we announced allocations of more than £150 million to local partners to deliver more than 3,300 new long-term homes for rough sleepers across the country.</p><p>Backed by a further £15 million, the ‘Protect Programme’ forms part of the ongoing targeted support to protect some of the most vulnerable people in our communities from COVID-19. This is on top of the previously announced £10 million Cold Weather Fund for all councils to help keep rough sleepers safe this winter. This takes the total we are spending to tackle homelessness and rough sleeping in 2020/21 to over £700 million.</p>

star this property answer text <p>The Government has established an unprecedented package of support to protect renters throughout the Covid-19 pandemic. This includes legislating through the Coronavirus Act 2020 to delay when landlords can evict tenants, a six month stay on possession proceedings in court and a range of financial support to enable renters to continue paying their living costs, including rental payments. <br> <br> To further protect renters over winter, we legislated in August to increase notice periods to six months in all but the most serious circumstances. This means that most tenants served notice now would not be asked to leave until at least May 2021. These increased notice period requirements will be in place until at least 31 March 2021. <br> <br> Alongside this, the Government has changed the law in England to ensure bailiffs do not enforce evictions over this period of national restrictions or the Christmas period. This means no eviction notices are to be served until 11 January 2021 at the earliest and, given the 14 day notice period required, no evictions are expected until 25 January 2021 at the earliest. The only exceptions to this are the most serious circumstances: illegal occupation, false statement, anti-social behaviour, perpetrators of domestic abuse, where a property is unoccupied following the death of a tenant in relation to housing association tenancies, and extreme rent arrears equivalent to 9 months’ rent with any arrears accrued since 23 March discounted. <br> <br> We believe this strikes the right balance between prioritising public health, supporting the most vulnerable renters and ensuring landlords can access and exercise their right to justice. <br> <br> We will continue to keep the need for emergency measures introduced by the Coronavirus Act 2020 under review, and will be informed by the latest public health situation and the effect on both tenants and landlords.</p>

It set out more detailed expert advice based on emerging and new evidence on building safety following the Grenfell Tower tragedy.</p><p>The Department is aware that the guidance has been used by insurers and lenders in their work to support valuations for mortgage purposes, using the RICS EWS1 process. The Government does not support a blanket approach in EWS1 use for lower risk properties. We are working with mortgage lenders to support a more pragmatic approach in their valuation of homes within multi storey residential buildings.</p> more like this

Higher rise buildings are the least likely to safely evacuate in the event of a fire spreading via external cladding.</p><p>It remains building owners’ responsibility to address unsafe cladding on buildings. Government funding should not be the only means of funding remediation. Building owners should meet the costs without passing them on to leaseholders wherever possible, through their own resources or by recovering costs from applicable warranty schemes or from the developers or contractors who were responsible for the installation of installed unsafe cladding, as has happened with more than half of the private sector buildings with Aluminium Composite Material cladding.</p> more like this

The Institution of Fire Engineers has informed MHCLG that there are around 291 chartered fire engineers who can carry out an EWS1 survey. Nonetheless, the Department is aware that there are challenges around availability of professionals to undertake fire safety assessments, including those who are employed in advising mortgage providers and industry on high rise and complex building safety.
