star this property answer text <p>Offences of using poison or instruments to cause miscarriage and supplying or procuring poison or instruments to cause miscarriage (sections 58 and 59 Offences Against the Persons Act 1861) are usually investigated by the police and, in England and Wales, prosecuted by the Crown Prosecution Service (CPS).</p><p>The CPS will only bring or continue with a prosecution where both stages of the test set down in the Code for Crown Prosecutors are met, i.e. that there is sufficient evidence to provide a realistic prospect of conviction and, if so, that a prosecution is required in the public interest.</p><p>In England and Wales, section 1 of the Abortion Act 1967 provides a defence to a prosecution under sections 58 or 59 where a pregnancy is terminated by a registered medical practitioner in accordance with the provisions of the Abortion Act 1967.</p> more like this

Between the years 2004-2005 and 2015-2016, the CPS commenced prosecutions of 71 abortion related offences. However, it is not possible to disaggregate the data to report the occupation of the defendant, whether a medical professional or otherwise. star this property answer text <p>This question relates to the differences in recording of data under section 76 of the Serious Crime Act 2015.</p><p>The data reported by the Crown Prosecution Service (CPS) in the answer to Question 112584 differs from that provided by the Ministry of Justice (MoJ) in the response to Question 112585 in that:</p><ul><li><p>CPS data is for the financial year; MoJ data for the calendar year.</p></li><li><p>CPS data includes all offences which have been commenced and have reached a first hearing in Magistrates’ Courts. A defendant may be charged with more than one offence. No central record is kept as to the outcome of the proceedings under s76 of the Serious Crime Act 2015.</p></li><li><p>In contrast, MoJ record the outcome of the proceedings by defendant and for whom this offence was the principal offences for which they were dealt with. When a defendant has been found guilty of two or more offences it is the offence for which the heaviest penalty is imposed.</p></li><li><p>MoJ data covers cases completed in Magistrates’ Court in 2016, and therefore includes both completed and live cases in the Crown Court.</p></li></ul>
