The CEK joint venture has provided HS2 Ltd with assurances that in the event any member of the group being unable to deliver on its responsibilities, the remaining members, now Eiffage and Kier, would fill the gap.</p> more like this

star this property answer text <p>The number of Carillion staff employed in the joint venture working on HS2 Phase One on Monday 15 January, date of liquidation, was 51. Eiffage and Kier’s aim is to make an offer to bring all 51 employees into either company; however not necessarily all will take up that offer.</p><p> </p><p>Discussions led by senior representatives from Eiffage and Kier are proposing that all Carillion staff deployed on the HS2 project would be given offers to remain on the project with equivalent service conditions as before to ensure continuity of service to HS2.</p><p> </p> more like this

HS2 has carried out additional due diligence and sought re-assurance of both Joint Venture partners, Kier and Eiffage, that they remain committed and capable to deliver the contract. Each company's Boards have both given that assurance and confirmed that they underwrite the performance of each other and have the capacity to deliver the HS2 contract.</p> more like this

star this property answer text <p>The rights of disabled persons and those with reduced mobility when travelling by air are important to the Government, and we are keen to see improvements happen where necessary. We welcome innovative ideas being discussed, such as the campaign “Flying Disabled” that champions wheelchair access to aircraft. The campaign is in early stages, with the industry looking further into the proposal. The Government will follow this work closely.</p><p> </p><p>More widely, the Civil Aviation Authority (CAA) is the national enforcement body for disabled passenger rights legislation in the UK. They work closely with the industry and monitor their performance to ensure the service the passengers receive is of high quality. The CAA publishes a report annually in which the UK airports are ranked as “very good”, “good” or “poor” in relation to the services and assistance they provide to disabled passengers and those with reduced mobility.</p> more like this

star this property answer text <p>We have made clear to HS2 Ltd that we expect them to always meet their obligations and responsibilities to the taxpayer. The progress of HS2 should not come at the expense of proper control over public money and HS2 Ltd fully accepts and understands this.</p><p> </p><p>However, HS2 Ltd have a legal obligation to honour the redundancy payments made to individuals who were employed and so will not be seeking their recovery. HS2 Ltd will manage these payments within their existing budgets and as such the Department for Transport will not be providing any additional funds to cover these costs.</p><p> </p><p>HS2 Ltd are putting in place controls to ensure that this does not happen again.</p><p> </p> more like this

star this property answer text <p>As a Joint Venture CEK were subject to the following contractual clause:</p><p> </p><p><strong>Z12 Joint and several liability</strong></p><p>Z12.1 If the <em>Contractor</em> is a Joint Venture</p><p>(1) each of the parties comprising the Joint Venture are jointly and severally liable to the <em>Employer</em> for the performance of this contract and all liabilities, acts and omissions of the <em>Contractor</em> under or in connection with this contract are the liabilities, acts or omissions of each party comprising the Joint Venture under or in connection with this contract,</p><p>(2) without limiting or prejudicing any other provisions of this contract, if any of the parties comprising the Joint Venture ceases to be a member of the Joint Venture or suffers one of the events described in clause 91.1, the other parties or party carry out and complete the <em>works</em> in accordance with this contract,</p><p>(3) the <em>Contractor</em> gives notice to the <em>Employer</em> and the <em>Project Manager</em> as to which of the parties comprising the Joint Venture has the authority to bind the <em>Contractor</em> for all the purposes of this contract and</p><p>(4) the <em>Contractor</em> keeps the <em>Employer</em> and the <em>Project Manager</em> informed promptly of any changes in the Joint Venture whether in relation to any incorporated entity or its constituent entities or the entities forming an unincorporated joint venture, including changes in legal status, the occurrence of any of the events described in clause 91.1, amalgamation, demerger, merger, deterioration in financial condition, de-ratings, major legal claims and suits, and any other matter or circumstance that could reasonably be deemed to be of concern to the <em>Employer</em> or the <em>Project Manager</em>.</p><p> </p><p>[Regarding (4) above, Carillion Construction Limited was subject to an ‘event described in clause 91.1’ when it was put into liquidation on 15 January 2018]</p><p> </p>
