As such, the Government’s legal position is clear: Article 127 does not need to be triggered for the Agreement to cease to have effect. In our position paper, the UK provided clear assurance that the CTA can continue to operate in its current form and can do so without compromising in any way Ireland’s ability to honour its obligations as an EU Member State, including in relation to free movement for EEA nationals in Ireland. If the EU wishes, the UK would be content for such an assurance to be reflected in the Withdrawal Agreement. As a priority we will seek a bold and ambitious Free Trade Agreement that is of greater scope and ambition than any such existing agreement.</p><p>As we have made clear in our future partnership paper, we believe the UK and EU should continue to consult each other on foreign and security policy issues and agree joint positions, so that we can speak out together and drive progress on areas in our mutual interest. As an example, we should look to coordinate action, and share information, on sanctions policy when needed in order to respond robustly to those who challenge the rules-based international order, as we have recently done effectively in the case of Russia and Iran. We are clear that we want the EU to succeed: a successful EU, with the UK as its closest partner, is in all of our shared interests.</p><p>We want to have the greatest possible tariff- and barrier-free trade with our European neighbours, as well as to negotiate our own trade agreements around the world. The Charter was not intended to create new rights but rather to catalogue the rights that already existed in EU law. The European Union (Withdrawal) Bill sets out how this underlying law is being converted into UK law at the point we exit the EU. <br><br>Furthermore, the Charter is not the only source of fundamental rights. Many of the rights protected in the Charter are not only found in EU law but are protected in domestic law and other international instruments, such as the European Convention on Human Rights.</p><p>For example, the right to protection of personal data (Article 8 of the Charter) is based on provisions in the EU Treaties, the Data Protection Directive (due to be replaced by an EU Regulation) and the respect for private life in Article 8 of the European Convention on Human Rights (ECHR), which is given effect domestically by the Human Rights Act 1998. DExEU is drawing together expertise from a wide range of departments where there is specific relevant knowledge. The Department has sourced a large proportion of experienced staff from across Whitehall on a loan basis and a number of secondees from the private sector and the wider public sector.
