When an offender being supervised by Probation dies, the Probation provider must examine the circumstances of the death and identify areas to improve practice. While we work extremely closely with each offender before and after release to help them find the support they need, we do not have sole responsibility for caring for these offenders. On release, he was supervised by the National Probation Service (NPS)</p><p> </p><p>When charged with that offence and remanded into custody on 21 August 2017, he was being supervised on licence by the NPS as part of the sentence of Imprisonment for Public Protection (IPP) which he received on 26 September 2008. An offender on an IPP licence is not recalled automatically when he is charged with a further offence or offences. The probation officer will consider whether the alleged further offences, prior offending and the offender’s current behaviour show that his risk has escalated to the point where he needs to be recalled to protect the public. The decision on whether to recall an offender is to be based on a robust assessment of risk and to reflect the professional judgment of a trained probation officer.</p><p> </p><p>The NPS has undertaken an urgent review to establish why Mr McCann was not recalled to custody, either when remanded into custody on 21 August 2017 or when he was sentenced on <ins class="ministerial">25 January 2018</ins> <del class="ministerial">15 February 2018</del>. Mr McCann has now been charged with a number of very serious offences committed on or after 21 April this year. This has triggered a mandatory serious further offence (SFO) review, under the Probation SFO Review Procedures. The SFO review will consider in greater depth than has thus far been possible, including by interviewing relevant members of staff, the question of whether Mr McCann should have been recalled to custody when charged with and subsequently convicted of the burglary offence. Where this amounts to a criminal offence, prisoners should expect to be investigated by the police and face more serious sanctions.</p><p>We are committed to improving safety across the prison estate and are already taking action. 	answer	answer is ministerial correction date of answer 01/03/2018 answer text <p>Prison officers do a challenging and vital job to help protect the public and we are committed to making sure we have enough staff to deliver safe regimes in our prisons.</p><p> </p><p>Detached duty is one of the sensible and proportionate measures we take to cover resourcing pressures and ensure we run safe and decent regimes in prisons as well as being able to respond appropriately to any operational issues that arise.</p><p> </p><p>In 2016 the former Secretary of State announced HMPPS would be recruiting an additional 2,500 prison officers by December 2018. Good progress is being made to hit this target, with 1,970 additional officers recruited by 31<sup>st</sup> December 2017. It sets out our vision to see fewer women in custody, especially on short-term sentences, and a greater proportion of women managed in the community successfully.</p><p> </p><p>Our vision for the ‘residential women’s centres’ pilot is the provision of an intensive residential support package in the community for women at risk of, or having served, short custodial sentences. The intention is to divert them from custody where appropriate and support them to address the underlying causes of their offending behaviour.</p><p> </p><p>We are not aware of any past or existing provision that fully accords with this, therefore we are unable to provide any information about how many places in women’s residential centres were funded by the Government in each year since 2010. We know that female prisoners are more likely than male prisoners to be a primary carer and imprisoned mothers are more likely to be living with their children prior to custody – around 60% of women compared with about 45% of men in prison who have children. Figures from a 2015 data matching exercise with the Ministry of Justice and the Department for Work and Pensions showed that between 24% and 31% of all female offenders were estimated to have one or more child dependents.</p><p><br>We know that when coming into contact with the criminal justice system, some women choose not to disclose that they have dependent children for a number of reasons. As such, iIt is difficult to create an accurate estimate of the number of women who choose not to disclose and to provide appropriate targeted support. However, we want all women to feel safe enough to disclose and are taking steps to encourage this, as outlined below. As the Chancellor set out in the budget on 30 October, we now intend to build the first two prisons through public capital at Wellingborough, which is due to open in 2021 and Glen Parva, which we expect to open in 2022 and we continue to explore funding options for the remaining prison places. The MoJ has provided funding to both, but does not oversee their work and bears no responsibility for maintaining records of them. Maps have been produced in the past showing snapshots of their number and location at that point in time. The women’s centres map was published in guidance for the police on working with vulnerable women, alongside the female offender strategy in June 2018; the rape support centres map has been shared with various stakeholders, but has not been published and there are no plans at present to publish it.</p><p>Our female offender’s strategy sets out a programme of work to improve outcomes for female offenders, based on our vision of seeing fewer women entering the justice system and serving short custodial sentences, and better conditions for those women in custody. 	answer	answer is ministerial correction date of answer 14/11/2018 answer text <p>The number of offenders sentenced to immediate custody for (a) up to and including 3 months and (b) over 3 months and up to and including 6 months for each Home Office offence code in 2017 can be viewed in the table.</p><p> </p><p>Sentencing is a matter for our independent courts, who take into account all circumstances of the case, including any aggravating and mitigating factors.</p><p> </p><p>Whilst there is persuasive evidence that short custodial sentences do not help some offenders turn their backs on crime, protecting the public will always be our top priority. Under this government, the most serious offenders are more likely to go to prison, and for longer, helping protect the public and keep communities safe.</p><p> </p><p>Our message is simple – if you commit a serious offence, you should expect to go to prison. 	answer	answer is ministerial correction date of answer 14/11/2018 answer text <p>The UK Living Wage (sometimes referred to as the ‘Real Living Wage’) and the London Living Wage, are both voluntary rates set by the Living Wage Foundation. These are not statutory figures which relate to the government policy in this area, and so are not legally binding on employers. The statutory minimum rates are the National Living Wage and the National Minimum Wage. For comparison, the National Living Wage is currently £7.83 per hour, and increased by 4.4% in April 2018. The increases in the National Living Wage and the National Minimum Wage have produced increases for over 2 million workers this year, across the economy, and increased pay by £2,000 for those on the minimum rate, since these statutory arrangements were introduced. 	answer	answer is ministerial correction date of answer 19/11/2018 answer text <p>As set out in my response to PQ178535, one of the measures Her Majesty’s Prison and Probation Service (HMPPS) implemented after stepping in to run HM Prison Birmingham was to temporarily reduce the operational capacity by 300 places. The capacity reduction was not immediate and was delivered over time with the gradual reduction of the prison’s population through a combination of: end of sentence releases, diversion of court allocations to other prisons in the region and routine allocations of sentenced prisoners to other establishments as part of their sentence progression as is normal for a prison with a ‘local’ function.</p><p>Men who were transferred were subject to the same criteria as all prison moves, taking into account a range of factors such as security category, resettlement needs and release address, offending behaviour needs and personal circumstances.</p> answering member constituency Penrith and The Border answering member printed Rory Stewart question first answered 19/11/2018 15:38:19 answering member 4137 label Biography information for Rory Stewart
