It is for the free school trust to ensure that its admission arrangements comply fully with the Admissions Code.</p><p>My Rt hon. Friend the Secretary of State for Education can agree different arrangements (‘derogations’ from the Code) for individual academies and free schools, but only in limited circumstances, and where there is demonstrable evidence that it would benefit local children. 54 free schools and three academies have specified derogations.</p><p>Anyone can object to the Schools Adjudicator if they have concerns about admission arrangements. The Schools Adjudicator will consider all objections to the admission arrangements of all state-funded schools, including mainstream free schools. Her decision is binding.</p> more like this

star this property answer text <p>All academies and free schools must comply with the School Admissions Code. This ensures their admission arrangements are fair, clear and objective.</p><p>However, in limited circumstances, the Secretary of State has agreed different arrangements for academies and free schools, where she is content that to do so will benefit local children. Such schools must comply with the Code other than in the very limited circumstances specified by the Secretary of State.</p><p>Whilst, at the time of replying to Question <a href="http://www.parliament.uk/business/publications/written-questions-answers-statements/written-question/Commons/2014-10-27/211963/" target="_blank">211963</a>, we explained that the Secretary of State had agreed specific freedoms for 54 free schools (including UTCs), that list now stands at 56, and is set out as attached.</p><p> </p> more like this

star this property answer text <p>Further to my response to Question <a href="http://www.parliament.uk/business/publications/written-questions-answers-statements/written-question/Commons/2014-10-27/211963/" target="_blank">211963</a>, I replied to your Question <a href="http://www.parliament.uk/business/publications/written-questions-answers-statements/written-question/Commons/2014-11-24/215695/" target="_blank">215695</a> on 1 December listing the (now) 56 free schools (including University Technical Colleges) where the Secretary of State has agreed specific freedoms. The reasons for agreeing these freedoms are listed below:</p><ul><li>Permission to prioritise admission of children of staff without having to meet the two-year qualification set out in the Admissions Code: granted to enable free schools to recruit good quality staff quickly, to benefit all pupils.</li><li>Permission to prioritise admission of pupils eligible for the pupil premium: granted prior to the Secretary of State extending that freedom to all academies and free schools.</li><li>Permission has been granted for three UTCs to adopt two admission numbers for entry, in order to balance entry to each of their distinct technical specialisms to recognise the availability of specialised provision.</li><li>Permission to prioritise admission of founders’ children: granted only to schools where individual founders have played a material role in setting up the free school and where they continue to be involved in the running of the school.</li><li>Meridian Angel Primary School was permitted to admit a group of displaced children who were being taught as a temporary measure in the local primary school’s annex.</li></ul>
