star this property answer text <p /> <p>I refer the Noble Baroness to the oral answer given by the Secretary of State for Work and Pensions, the Rt.Hon. Iain Duncan Smith, Official Report, 8 December 2014, column 633. He set out how the Department for Work and Pensions will be doing much more to raise awareness of Short Term Benefit Advances (STBAs) as recommended by the All-Party Parliamentary inquiry and others, including the Social Security Advisory Committee. This will include providing more information to claimants about STBAs online and in Jobcentres. Staff guidance on STBAs will also be updated and staff reminded of the process for considering an STBA.</p><p> </p><p>A key part of the STBA process is a discussion between the claimant and the Decision Maker to consider the circumstances of the request and make an informed discretionary decision about the claimant’s needs. Such a discussion needs to be had with the claimant and cannot be done online or with a third party.</p><p> </p><p>Benefits are normally paid in arrears and where the Department can pay any benefit due to the claimant it does. Where an STBA can be paid it is usually paid the day after it is first requested by the claimant.</p><p> </p><p>The Government believes the current system for claiming STBAs is simple. All claimants need to do is mention to staff that they will not be able to manage until their payment is due and the STBA process will start. However, the Government has accepted the need to raise awareness of STBAs as set out above.</p><p> </p><p>The Government has made improvements to the hardship process. In July 2014 it strengthened guidance for work coaches so that all claimants are informed about how and when they can make an application for hardship payment and processing times have also been improved.</p>

Regulation (EC) No 987/2009 is the implementation regulation which provides for administrative co-operation between Member States to implement the co-ordination regulation.</p><p> </p><p>Article 6 provides for a Member State to make benefit payments on a provisional basis as the Member State of residence if there is a dispute with another Member State as to who is responsible for the payment of benefits. Article 7 provides for a Member State to make a provisional award of benefit if another Member State has not provided all the evidence requested from them.</p><p> </p><p>The Government does not collect information on the number of provisional benefit payments made on the basis of either Article 6 or 7 of Regulation (EC) No 987/2009.</p><p> </p><p>There is published guidance on how to determine an award of benefit through the application of Article 6 (Annex A DWP Annex B HMRC). This is part of the Decision Makers Guidance which is made available to the public.</p><p> </p><p>In domestic guidance there is the facility for a decision maker to make an award of benefit where the evidence required is incomplete, with a revision of that award undertaken, if appropriate, once the required evidence is received. This would cover claims made under Article 7. Each claim to benefit is assessed on a case by case basis.</p>

star this property answer text <p> </p><p> </p><p>We recognise that volunteering in the local community can be invaluable in helping benefit claimants, including inactive people, gain new skills and experience that will help them back into work.</p><p> </p><p>In Jobseekers Allowance, claimants are able to volunteer so long as they meet the conditions of claiming, namely looking for and being available for work.</p><p> </p><p>Employment and Support Allowance (ESA) claimants can do unlimited, voluntary work, it will not affect ESA.</p><p> </p><p>For Universal Credit claimants, advisers will be able to reduce a claimant’s expected hours of worksearch and work preparation activities by up to 50 per cent in order to accommodate voluntary work. However the claimant can continue to do as much voluntary work as they feel they are able to, as long as they continue to meet their other work-related requirements.</p> more like this

We are currently considering the consultation responses.</p><p><strong> </strong></p><p>Deductions from Universal Credit are made after considering the claimant’s individual circumstances and ability to afford the deductions. The maximum that can be deducted for all deductions, including rent arrears, is an amount equivalent to 40 per cent of the claimant’s Universal Credit Standard Allowance. star this property answer text <p>The Government’s response to the consultation on new measures of child poverty can be found in Annex E of the attached document. The analysis of the results in 2013 recorded that two respondents to the consultation said income should not be included in a measure of child poverty.</p><br /><p>We cannot give the names of the respondents due to Data Protection Act requirements. However, one was from an academic organisation and the other was from a frontline service.</p><br /><p>The Government wants to focus future effort on tackling the root causes of child poverty. That is why the life chances provisions in the Welfare Reform and Work Bill will introduce new measures of worklessness and educational attainment, and why we have committed ourselves to introducing a set of non-statutory indicators including ones on family breakdown, problem debt and addiction. These measures will focus action on the areas which the evidence indicates will make a sustainable difference to children’s lives - now and in the future.</p>
