In the Autumn Budget 2017, the government confirmed 18 further measures and additional investment in HMRC to tackle avoidance, evasion, and non-compliance.</p><p> </p><p>HMRC has generated over £160 billion of additional yield since 2010 from tackling avoidance, evasion and non-compliance. Contracts for Difference (CfDs) and other derivative products are regulated by the Financial Conduct Authority (FCA). The FCA have expressed concerns about the distribution of CfDs to retail clients, and the European Securities and Markets Authority (ESMA) have recently announced that they are considering imposing restrictions on these CfDs. As the independent regulator, the FCA have indicated that they are supportive of these proposals. As ESMA’s powers are temporary, the FCA are considering appropriate permanent product intervention measures, which the FCA indicated would take in to account any prospective ESMA measures. The government has legislated to transfer responsibility for the regulation of binary options from the Gambling Commission to the Financial Conduct Authority from 3 January 2018. The FCA recently warned investors about the risks of investing in binary options. The European Securities and Markets Authority have recently announced that they are considering measures to prohibit the marketing, distribution or sale of binary options to retail clients in the EU to address the significant risks to investors associated with this product. To date, the Yorkshire and Humber region has received more than £1.3 billion from the Local Growth Fund.
