star this property answer text <p>Local authorities have a wide range of enforcement powers to tackle fly-tipping and we have recently strengthened these. In 2016 we gave local authorities the power to issue fixed penalty notices for small scale fly-tipping and enhanced local authorities’ ability to search and seize the vehicles of suspected fly-tippers. In January this year, we introduced further financial penalties to crack down on fly-tipping giving local authorities the power to issue penalties of up to £400 to householders who fail to pass their waste to a licensed carrier and whose waste is then found fly-tipped. We will also support local authorities in increasing householders’ awareness of their duty of care to ensure their waste is disposed of appropriately.</p><p> </p><p>In our Resources and Waste Strategy for England, we have <del class="ministerial">included</del> <ins class="ministerial">committed to develop a</ins> fly-tipping toolkit which will cover how local authorities can set up and run an effective fly-tipping partnership and how to present robust cases to court to ensure tougher penalties. The Strategy also sets out how we will work with the court system to further strengthen the sentences of fly-tippers to ensure they act as a suitable deterrent.</p>

star this property answer text <p>We are taking strong action to tackle waste crime. We have created a Joint Unit on Waste Crime. The Environment Agency has received an extra £60m to tackle waste crime since 2014. We have updated legislation regulating waste. These include increasing the powers for the Environment Agency to tackle problem waste sites, enhanced technical competence requirements for permitted waste sites, and introducing new penalties for breaches of the duty of care for household waste. We will further reform the legislative framework for the waste duty of care and carriers, brokers and dealers, mandating the digital tracking of waste (subject to consultation), tackling the waste exemptions most often linked to criminal activity and enhancing operator competence.</p><p> </p><p>We are developing a toolkit for local authorities and others to tackle fly-tipping, including specific guidance on strengthening evidence for prosecution cases. We will work with magistrates and the Judicial Office to raise awareness for magistrates of the prevalence and importance of tackling waste crime, including fly-tipping, and offer training in the environmental offences sentencing guideline.</p><p> </p><p>The Government has provided local authorities with over £200 billion for this spending period. While councils make their own spending decisions, we would expect councils to prioritise these to deliver what their residents want to see, including investing in tackling fly-tipping.</p><p> </p>

There are also separate categories for white goods, electrical items and green waste which may originate from household or commercial sources. It is not possible to distinguish the original source.
