If the number of disposals are five or fewer, the average disposal time is redacted.</p><p> </p><p>Although care is taken when processing and analysing the data, the details are subject to inaccuracies inherent in any large-scale case management system and are the best data that are available. Data include appeals cleared with and without a Tribunal hearing.</p><p> </p><p>Waiting times are calculated from receipt of an appeal to its final disposal. An appeal is not necessarily disposed of at its first hearing. The final disposal decision on the appeal may be reached after an earlier hearing had been adjourned (which may be directed by the judge for a variety of reasons, such as to seek further evidence), or after an earlier hearing date had been postponed (again, for a variety of reasons, often at the request of the appellant). An appeal may also have been decided at an earlier date by the First-tier Tribunal, only for the case to have gone on to the Upper Tribunal, to be returned once again to the First-tier, for its final disposal.</p><p> </p><p> </p><p>HMCTS recognises it is important for appeals to be heard as quickly as possible, and is in the process of recruiting more judicial office holders to the SSCS jurisdiction in order to increase capacity and help to reduce waiting times for appellants. In 2018, 118 specialist members were appointed and trained to the jurisdiction, and an extra 129 fee-paid judges were appointed in 2019. The jurisdiction will also benefit from 114 salaried judges and 170 fee-paid judges being recruited across tribunals more widely.</p>

star this property answer text <p>The latest period for which data about appeals to the First-tier Tribunal (Social Security and Child Support) (SSCS) are available is January to March 2020 which predates the pandemic.</p><p>www.gov.uk/government/collections/tribunals-statistics.</p><p>The most recent tribunal statistics publication covering the period April to June 2020 does not include SSCS data due to issues identified as the Tribunal was being migrated to a new operational system. The data will be made available as soon as this is resolved and the data quality assured.</p><p>Appeals to the SSCS Tribunal have continued to be heard in line with government guidance throughout the pandemic. Telephone hearings and the use of other hearing technology have been used to facilitate as many hearings as possible being held remotely.</p><p>In addition to holding remote hearings in all regions, appeals may also be decided by judges sitting alone in chambers, using the evidence before them in the case papers.</p><p>HM Courts &amp; Tribunals Service has also introduced safety measures so that face to face hearings can be held for any cases which cannot be decided on the papers or heard remotely.</p><p>The decision as to how a hearing is conducted is a matter for the judge, who will determine how best to uphold the interests of justice. In considering the suitability of video/audio hearings to replace face to face hearings, judges will consider matters such as the nature of the dispute at stake and any issues the use of video/audio technology may present for participants in the hearing, having regard to individuals’ needs.</p>

star this property answer text <p>The Child Maintenance Group has the following powers which can be applied immediately if payment compliance cannot be re-established and are subject to fixed charges:</p><p> </p><ul><li>deduction of earnings order. £50.00 charge</li><li>deduction from earnings request. £50.00 charge</li></ul><p>If the paying parent is self-employed or not employed, we can apply:</p><p> </p><ul><li>regular deduction order. £50.00 charge.</li><li>lump sum deduction order. £200.00 charge</li></ul><p>If a bank account is not identified or there are no or insufficient funds available to permit any deduction order, the case will be referred for consideration and instigation of Legal Enforcement action to secure what is owed, and always to strive for long term payment compliance. The following Enforcement powers available are:</p><p> </p><ul><li>lump sum deduction order</li><li>regular deduction order</li><li>freezing order</li><li>set aside disposition order</li><li>liability order £300 charge</li><li>registering liability order at county court (England and Wales)</li><li>registering liability with the Register of Judgements, Orders and Fines</li><li>registering liability with the Enforcement of Judgments Office (Northern Ireland)</li><li>charging order (England and Wales)</li><li>order for sale</li><li>enforcement agent action (England and Wales)</li><li>third party debt order (England and Wales)</li></ul><ul><li>disqualification from holding or obtaining a driving license</li><li>commitment to prison</li><li>disqualification from holding or obtaining a passport (England and Wales only)</li></ul><p> </p><p>Throughout the Enforcement process, the case will continuously be reviewed to determine whether previously unsuccessful action may now be successful.</p><p> </p><p>CMG regularly reviews Enforcement procedures and policies to continuously improve efficiency and effectiveness. Legislation and policy are similarly reviewed with policy colleagues to consider whether other actions should be introduced. In December 2018 new legislation was introduced in England, Scotland and Wales to request a non-compliant paying parent is disqualified from holding or obtaining a UK passport. The Curfew sanction will be introduced in December 2022 to be available for implementation in early 2023.</p><p> </p>

star this property answer text <p>It is a key principle that unpaid child maintenance should be paid immediately. Where a parent fails to pay on time or in full, the CMS will take action to re-establish compliance and collect any unpaid amounts that have accrued. Where compliance cannot be achieved the CMS actively pursues all outstanding child maintenance using a variety of enforcement options including deductions from earnings, deductions from benefits and identifying and securing cash balances and assets through its enforcement actions. If non-compliance persists, then sanctions including commitment to prison or the disqualification of a driving licence and removal of passport is considered.</p><p /> more like this
