star this property answer text <p>The CPS, as with all government departments, has seen a reduction in funding since 2010. Whilst it has been a challenge, it is very important to recognise that the CPS has managed to maintain its performance. It is testament to the professionalism and commitment of the staff that has enabled this, reforming all aspects of how the organisation is managed to find efficiencies wherever possible. The CPS is now amongst the most digital prosecution services in the world.</p><p> </p><p>The CPS has a budget to enable its resourcing; the Law Officers will continue to work with them and HMT to ensure that this is the case and that their needs are reflected in any future Spending Review.</p> more like this

star this property answer text <p>Government Departments are working quickly to tackle knife crime and the CPS continues to prosecute knife crime robustly. Charges for offensive weapons and possession of a bladed article increased to 27,525 in 2017/18, compared with 25,993 in 2016/17.</p><p> </p><p>I attended the Serious Youth Violence Summit hosted by the Prime Minister in April to discuss this serious issue. Following the Summit, cross-government work will now be overseen and driven forward by the new Serious Violence Strategy Implementation Taskforce chaired by the Prime Minister. The Attorney General will be a member of this Taskforce, and both he and I regularly engage with discussions about effectively tackling knife crime.</p> more like this

We know this requires a multi-agency response and that is why both the Serious Fraud Office (SFO) and Crown Prosecution Service (CPS) play their part, alongside others, including through their support of the new multi-agency National Economic Crime Centre (NECC).</p><p>The NECC, which has been operational since October 2018, will drive the tasking and coordination of the UK's response to economic crime. star this property answer text <p>The CPS has considered the types of data it collates and has determined that it would not be appropriate to create a new dataset which overlaps with the information already collected and published by the Home Office. CPS collects data for operational purposes; the Home Office however report the National Statistics which are the official figures reported to Parliament.</p><p>Recent figures published by the Home Office report that last year, 84 people were tried following charges brought by the CPS for terrorism-related offences, resulting in 76 convictions. star this property answer text <p>The Crown Prosecution Service (CPS) maintains a central record of the number of suspects referred to prosecutors for a pre-charge decision and the number of decisions not to prosecute suspects following the charging decision.</p><p>When prosecutors make decisions on cases, they refer to The Code for Crown Prosecutors. The Code contains a two stage test which has to be met before a suspect can be charged; the evidential stage followed by the public interest stage. When deciding whether there is enough evidence to charge, prosecutors must consider whether evidence can be used in court and is reliable and credible, and there is no other material that might affect the sufficiency of evidence. Prosecutors must be satisfied there is enough evidence to provide a &quot;realistic prospect of conviction&quot; against each defendant. At the public interest stage the prosecutor must consider whether a prosecution is required in the public interest. star this property answer text <p>All complainants are entitled to protection from unnecessary and unjustified invasion of their private lives. Medical records and counselling notes will routinely engage an individual’s Article 8 ECHR right to privacy.</p><p> </p><p>CPS guidance is clear that where it is a reasonable line of enquiry in the investigation, the police should obtain the complainant’s informed consent to gain access to these records and, in the limited circumstances where it is appropriate, to enable disclosure of material to the defence. Where records amount to unused material, prosecutors will robustly apply the relevant statutory provisions when deciding whether such material should be disclosed to the defence.</p><p> </p><p>The CPS is working with the police and stakeholders to ensure complainants are aware of why their records are required and how they will be used to allow them to make an informed decision.</p><p> </p> more like this

For example, in the period between 2013/14 and 2017/18, there was an increase of over 26% in rape flagged pre-charge decisions referred to CPS West Midlands. Rape and serious sexual offences investigations can be highly complex in nature and typically involve the review of a large quantity of evidence resulting in an increase in the amount of time required for the CPS to come to a charging decision.</p>

star this property answer text <p>There are no plans to establish a public inquiry. The independent Electoral Commission is responsible for ensuring that elections and referendums are run effectively and in accordance with the law. It regulates the spending of, and donations and loans, to political parties and other campaigners.</p><p> </p><p>It is not acceptable for any organisation to breach electoral procedures – and it is regrettable that fines have been levied on multiple groups on both sides of the referendum campaigns. Pro-Remain groups outspent pro-Leave groups by £4 million in the referendum campaign.</p><p> </p><p>With 17.4 million votes to leave the European Union, more people voted for Brexit than have ever voted for anything else in the United Kingdom. Almost three quarters of the electorate took part in the referendum. The result was a bigger popular vote than won by any government in history. The will of the British people must be respected and delivered. The public delivered a clear verdict and that is what the Government is implementing.</p>

star this property answer text <p>It remains the Government’s intention to leave the EU with a deal and not participate in European Parliamentary elections.</p><p>In preparation for the delivery of elections, Returning Officers, who are statutorily independent, will work to deliver the polls, including through following guidance issued by the Electoral Commission.</p><p>The Electoral Commission’s guidance advises Returning Officers to prioritise postal ballot packs that are to be sent overseas in order to allow as much time as possible for the ballot pack to reach the elector and to be completed and returned. The Government has agreed to fund International Business Response Licences for the return of postal votes from overseas and has met with Royal Mail and British Forces Post Office to ensure there is effective planning in place for the dispatch and return of postal votes from overseas including those for service voters based overseas.</p> more like this

star this property answer text <p>It remains the Government’s intention to leave the EU with a deal before the 23 May, so we do not need to participate in European Parliamentary elections.</p><p>Electoral Registration Officers (EROs) maintain their own register for the area for which they are responsible. EROs should write to EU citizens informing them of their right to vote and request they confirm whether or not they wish to vote at a European parliamentary election in the UK or in their home country.</p><p>Moreover, the Government has made registering to vote easier for all citizens, including those from the EU, with an online application taking as little as 5 minutes. The Individual Electoral Registration digital service has been a huge success, facilitating over 38 million applications; with over 75% of these being made online since its introduction in 2014.</p> more like this
