star this property answer text <p>The Member for East Renfrewshire will be aware of my decision, alongside the Advocate General’s for Scotland, to refer the UN Convention on the Rights of the Child (Incorporation) (Scotland) Bill to the Supreme Court on legislative competence grounds. We have also referred the European Charter of Local Self-Government (Incorporation) (Scotland) Bill.</p><p> </p><p>It would not be appropriate for me to comment in detail on what are live proceedings.</p><p> </p><p>Ultimately, our concerns with regards to these Bills do not relate to their policy content, nor to the approach the Scottish Parliament has taken in incorporating these international agreements into Scots law. Rather they relate to specific provisions in the Bill and whether they fall outside the Scottish Parliament’s legislative powers.</p> more like this

star this property answer text <p>I have seen first-hand how innovatively and resiliently criminal justice agencies have responded to the pandemic to boost court capacity – in June 2020, I observed virtual hearings conducted via the Cloud Video Platform in Bristol Magistrates’ Court.</p><p>I have also met with various CPS Areas to discuss their approach, and know that the CPS is committed to working closely with the courts service and judiciary on court recovery work. This is an unprecedented challenge, but I have been impressed with the truly collaborative approach criminal justice partners have taken.</p> more like this

star this property answer text <p>The CPS is working closely with partner agencies across the criminal justice system to reduce the current backlog of cases created by the Covid-19 outbreak. This includes both internal measures to deal with larger live caseloads in CPS Areas and working closely with partners to ensure maximum throughput of cases at court.</p><p> </p><p>Considerable progress is being made. In the honourable member’s constituency, Merthyr Magistrates’ Court has now reduced its backlog to pre-COVID levels.</p> more like this

star this property answer text <p>I am delighted that my revised Disclosure Guidelines have now been published. These Guidelines will come into force on 31 December and will be key to the requisite culture change and thinking approach needed when investigators and prosecutors carry out their disclosure obligations.</p><p> </p><p>This will ensure that better, fairer decisions are made in criminal cases, which will help to ensure that fewer cases are dropped post-charge due to issues arising due to late disclosure.</p> more like this

star this property answer text <p>I am committed to ensuring rape and sexual assault cases are conducted effectively – in fact, I recently successfully referred a point of law to the Court of Appeal to ensure that the law is clear in cases of sexual assault.</p><p>I have also engaged closely on CPS rape work, including meeting with CPS South East in December 2020 to discuss how their RASSO unit approaches these complex cases. The CPS and police also published their Joint National Action Plan on rape in January 2021 which shows their commitment to improvement.</p><p> </p> more like this

It will continue to work with the Withdrawal Agreement Joint Committee and final decisions are expected in the coming days.</p><p> </p><p>The duty of the Law Officers is to ensure that the Government acts lawfully at all times. I take that responsibility seriously, and that will not change after the end of the transition period, regardless of whether we reach negotiate a deal with the EU.</p> more like this

star this property answer text <p>The CPS has worked with other prosecutors, law enforcement, the courts, and the Home Office to ensure that effective international cooperation with EU Member States on extradition, gathering of evidence and asset recovery can continue after the Transition Period.</p><p> </p><p>Extensive preparation has taken place to prepare for the outcome of the negotiation and there are well-prepared and well-reheased plans in place – which include producing guidance and training for prosecutors. The CPS has also engaged extensively with EU counterparts in order to safeguard existing and new cases.</p> more like this
