star this property answer text <p>We are committed to supporting restorative justice as a way to help victims cope and, as far as possible, recover from the impact of crime. That is why, under the Code of Practice for Victims of Crime (‘the Victims’ Code’), all adult victims must be told about the option of restorative justice and how to access it. We also provide Police and Crime Commissioners with grant funding for victim support services, including restorative justice services. They are best placed to assess local need and commission services based on the needs of the population in the local area. Restorative justice services should be targeted to the most appropriate cases, where we have clear evidence for the benefits of that approach and should only take place when both the victim and the offender agree, and it is considered safe.</p><p> </p><p>HMPPS has work underway to look at how to better support MoJ funded restorative justice. This work is aimed at identifying the factors supporting quality practice and to test effective, evidence-based access to, and delivery of RJ services.  HMPPS will also work with PCC areas to improve referrals to RJ services. Once complete HMPPS will share the lessons learned more widely.</p><p> </p><p>We do not currently plan to publish a restorative justice action plan because it is not clear that this is necessary or an appropriate fit with the existing activity to improve the consistent and targeted provision of restorative justice services at a local level.</p>

The police are required to investigate all cases that are referred to them – and all cases should be treated equally in terms of their approach to investigation.</p><p> </p><p>The Government’s policies should not, therefore, have a negative impact on the ability of the police to investigate, or for the courts to deal with, such false accusations.</p> more like this

A defendant, committed by the magistrates’ court to the Crown Court, may not complete both court processes in the same year. Each stage would therefore be counted by the particular court in the year where those proceedings took place or completed, meaning that in any given year, convictions may exceed prosecutions and sentences may not equate to the number of convictions. In addition, defendants who appear before both courts may also be convicted of a different offence at the Crown Court to that counted during proceedings in the magistrates’ court, where the offence may have changed after committal to the Crown Court.</p><p> </p><p>The Ministry of Justice does not collate information separately on whether a prosecution also concerns one of domestic homicide. Data is unavailable on the partial defence of loss of control.</p>

star this property answer text <p>Tackling knife crime is a priority and this Government is determined to do all it can to break the deadly cycle of violence that devastates the lives of individuals, families and communities. I welcome the consultation published by the Home Office this week which contains proposals to tackle the use of machetes and other bladed articles in crime.</p><p> </p><p>While sentencing is a matter for our independent courts, this Government introduced measures through the Police, Crime, Sentencing and Courts Act 2022 to ensure that, when sentencing for threat with or repeat possession of a knife, the courts must pass at least the minimum sentence unless there are exceptional circumstances.</p><p> </p><p>Since 2010, the average custodial sentence length for knife possession has increased by almost 20%.</p> more like this

star this property answer text <p>The decision to remand an individual in custody or to grant bail is solely a matter for the courts acting in accordance with the Bail Act 1976.</p><p>Time spent remanded on bail does not count towards time served unless, as a defendant, the offender was remanded on bail with an electronically monitored curfew of 9 hours or more per day. An electronically monitored curfew of 9 hours or over can result in a credit of half a day of custodial time. If compensation against time in custody is to be considered by the court following sentencing, they will need to be satisfied that the electronically monitored curfew was fully complied with on each day that is taken into account.</p> more like this

star this property answer text <p>In June 2021, we published the End-to-End Rape Review Action Plan. The Action Plan set out an ambitious programme of work to drive improvements throughout the system and achieve better outcomes for victims, which will help to increase the rate of prosecutions for rape cases across the country.</p><p>We also set our public ambition to return the number of adult rape cases referred, charged, and reaching court by the end of this Parliament to 2016 levels. We are on track to reach our ambition for all three metrics.</p><p>To support improvements in London specifically, the London Metropolitan Police joined Operation Soteria, our flagship joint police and CPS programme which is working to transform the way that rape investigations are handled and progressed, in December 2021. We are also working with Snaresbrook Crown Court through our Specialist Sexual Violence Support project to improve the victim experience at the court stage. We have also provided £10.1m of ringfenced funding to MOPAC to commission sexual violence services to support victims at every stage of the criminal justice system.</p>

star this property answer text <p>The Government does not centrally collate data on the average cost of appointing Independent Sexual Violence Advisors (ISVAs) and Independent Domestic Violence Advisors (IDVAs). The Ministry of Justice (MoJ) collects information on the number of ISVA and IDVA posts funded by the Department through commissioning arrangements with local Police and Crime Commissioners (PCCs) to recruit ISVAs and IDVAs. It does not hold information on posts funded through other sources of funding such as other government departments, local authorities or third sector organisations and bodies. As such, it is not possible to provide an estimate on the total number of ISVA and IDVA posts nationally and indeed the average cost to the public purse. Some ISVAs work in multiple courts, according to their area or case load, and therefore this cannot be broken down to individual courts.</p><p> </p><p>The MoJ has committed ringfenced funding to increase the number of ISVAs and IDVAs funded by the department by 300 to over 1000 by 2024/25 - a 43% increase on the number of ISVAs and IDVAs over this spending review period (2022/23 to 2024/25 inclusive). For 2022/23, we provided £34 million of ringfenced funding for ISVAs and IDVAs. PCCs are required to report bi-annually to MoJ as part of grant funding arrangements.</p>
