	answer	answer is ministerial correction date of answer 28/10/2015 answer text <p>The legal distinction between an employee and a volunteer is complex given the differences between the types of voluntary work and volunteering activities that individuals can be involved in. The principal difference is that volunteering must not amount to unpaid work or job substitution. In particular: there should be no payment, other than reasonable travel and meals expenditure actually incurred (not an allowance for the same); there should be no contractual obligations on the volunteer; the volunteer is helping a registered voluntary or charitable organisation (or organisation that raises funds for either); the volunteering is for a public sector organisation; and the volunteering is not a substitute for employment (i.e. fulfilling a role that a salaried worker would normally fulfil).</p><p>Although it is Home Office policy to support asylum seekers volunteering for charities or public sector organisations; we make it clear that it is the responsibility of any organisation considering recruiting volunteers to ensure that such activity does not constitute voluntary work or employment. 	answer	answer is ministerial correction date of answer 30/10/2015 answer text <p>In 2012, the Government introduced new rules to break the link between coming to the UK to work and settling permanently. Under these rules, which take effect from 6 April 2016, non-EEA workers will need to earn at least £35,000 to remain permanently, in order to ensure that those who settle are those who make the greatest economic contribution to the United Kingdom. Those in PhD level occupations or whose roles are in shortage will be exempt from the £35,000 threshold. Workers who do not meet the settlement rules after six years will be expected to leave the UK when their visa expires.</p><p>On 15 October, the Home Secretary announced that nurses will be added to the Government’s Shortage Occupation List on a temporary basis, pending a full review by the independent Migration Advisory Committee. This will ease pressure on the NHS at a time when the Government is introducing tough new controls on costly agency spending. The Dublin Regulation is a vital tool in our ability to manage asylum claims, including repeated claims.</p><p>The European Commission has proposed a review of the Dublin Regulation with a view to bringing forward a new measure for negotiation next March. That judgment relates to the appeals processes for asylum claims under the Fast Track procedure rules. The provision in the Immigration Bill which extends the power to certify to require appeals to be brought from overseas where that will not result in a breach of human rights applies only to human rights claims.</p><p>The Court of Appeal recently considered the operation of the certification provisions that were introduced in the Immigration Act 2014, for those liable to deportation and held that the provisions were lawfully applied. We have provided over 1000 days of staff time on 20 missions over 3 years, more than any other Member State. 	answer	answer is ministerial correction date of answer 11/11/2015 answer text <p>The Government has always been clear that the Right to Rent scheme would be rolled out across the country after phase one in Birmingham, Walsall, Sandwell, Dudley and Wolverhampton. The Prime Minister committed to do so in May this year. Home Office Science has carried out an evaluation of phase one. The findings of the evaluation have now been published and are informing implementation of the roll out of the scheme.</p><p>The evaluation was overseen by an expert panel consisting of representatives from landlords and letting agents associations, housing charities, local authorities and the Equality and Human Rights Commission, to enable concerns about the operation of the scheme to be taken into account.</p><p>The Home Office evaluation reported on mystery shopping research, conducted by independent contractors.
