	answer	answer is ministerial correction date of answer 21/11/2014 answer text <p /> <p>This government is committed to tackling domestic violence and abuse and to delivering a better response for the victims of these appalling crimes.</p><p> </p><p>We have ring-fenced £40 million for victims’ services; piloted and rolled out Clare’s Law and domestic violence protection orders; extended the definition of domestic abuse to cover controlling behaviour and teenage relationships; run two successful campaigns to challenge perceptions of abuse; placed Domestic Homicide Reviews on a statutory footing to make sure lessons are learnt from individual tragedies; criminalised forced marriage and consulted on the creation of a single criminal offence of domestic abuse.</p><p> </p><p>The Ministry of Justice Court Proceeding Database holds information on offences provided by the statute under which proceedings are brought but not all the specific circumstances of each case. Data on those proceeded against, found guilty and sentenced for offences involving domestic violence, such as threatening behaviour, violence or abuse between adults are not separately identified in the data reported centrally to the Ministry of Justice. Furthermore, it is not possible to separately identify the relationship between defendant and victim, and their gender. Before doing so, Staffordshire Police, West Yorkshire Police and Leicestershire Police are piloting a new, two-tier framework for out of court disposals based on the conditional caution and the community resolution.</p><p> </p><p>Police officers in these areas, as in other parts of England and Wales, may in exceptional circumstances administer a conditional caution for an indictable only offence and must seek the permission of the Crown Prosecution Service (CPS) before doing so. Crime is falling and offenders are going to prison for longer. This Government has taken action to end cautions culture, and to make sure serious offenders do not receive penalties seen as soft options.</p><p> </p><p> </p><p>We are changing the law to ban ‘simple’ cautions for all of the indictable only offences - the most serious criminal offences which must be tried in the Crown Court including rape, manslaughter and robbery.</p><p>We are also banning ‘simple’ cautions for possession of any offensive weapon (including a knife), supplying Class A drugs and a range of sexual offences against children, including child prostitution and pornography.</p><p>We have also outlined a new approach to scrap all cautions, which is being piloted in Staffordshire, West Yorkshire and Leicestershire, with a view to being extended across the country.</p><p><strong> </strong></p><p>The current simple cautions are a non-statutory disposal available to the police to dispose of any offence committed by an adult and are designed for dealing with low level, mainly first time offending.</p><p> </p><p>The Ministry of Justice issues guidance on the process to be followed by the police when they are administering simple cautions for adult offenders. The latest guidance, issued in November 2013 following the Simple Cautions Review, states that the use of a simple caution for indictable only offences, such as rape, should only be given following authorisation by a senior police officer of at least the rank of Superintendent and the Crown Prosecution Service. The theft of items from graves is a heartless and callous crime which can have a devastating impact on bereaved relatives and friends. If the offenders responsible are detected they can expect to feel the full force of the law.</p><p> </p><p>The Ministry of Justice Court Proceedings Database holds information on defendants proceeded against, found guilty and sentenced for criminal offences in England and Wales. However, not all offences are individually reported within the centrally held data. Offences of grave robbery are reported as part of a wider group of offences and cannot be separately identified from other offences under the Theft Act. By March 2015 we will:</p><p>· devise a requirement that to be instructed in cases involving serious sexual offences, publicly-funded advocates must have undertaken approved specialist training on working with vulnerable victims and witnesses;</p><p>· give vulnerable witnesses greater opportunity to give evidence from a location away from court that better supports them to give their evidence, with at least one such location available in each court region;</p><p>· set out a programme for national roll-out of pre-trial cross-examination for child victims, subject to the evaluation of the pilots; and</p><p>· support the Director of Public Prosecutions’ consultation on providing better information and support to victims both before and at court so that they are better prepared for trials.</p><p> </p><p>And as we modernise the courts, we will ensure that victims’ needs are at the forefront of our plans.</p><p> </p><p>Taken together, these reforms will ensure that where victims give evidence, they can do so with in a less aggressive courtroom atmosphere, to reduce their anxiety.</p> answering member constituency Hemel Hempstead answering member printed Mike Penning question first answered 17/11/2014 17:20:32 answering member 1528 label Biography information for Sir Mike Penning
