star this property answer text <p>Train operators are expected to have fair and transparent processes for considering Delay Repay applications as set out in detail in their Passenger’s Charter. The train operators use industry delay data provided by Network Rail, who have an obligation to ensure that this delay data is accurate.</p><p> </p><p>If any passenger is unhappy with the decision taken by the train operator with regards to a Delay Repay claim, then they will shortly be able to take this up with the new Rail Ombudsman.</p> more like this

star this property answer text <p>Passengers who are delayed due to the cancellation of a scheduled train service but who have to travel on a subsequent train or take a taxi to complete their journey should be entitled to compensation in accordance with the Train Operating Company’s (TOC’s) published Passenger’s Charter. The passenger’s arrival time at their destination should determine their entitlement to Delay Repay compensation.</p><p> </p><p>The majority of TOCs operate the Delay Repay compensation system which provides compensation to the value of 50% of the ticket price for delays or cancellations when the passenger is delayed in reaching their destination by 30-59 minutes. Delay Repay 15 (DR15) additionally entitles passengers who have been delayed by 15-29 minutes to compensation worth 25% of the ticket price. The next TOC to introduce this will be Northern expected by the end of December.</p><p> </p><p>The rail industry has also recently launched the new Rail Ombudsman service, which will give passengers a stronger voice and help ensure they get a fair deal when disputes with train operators cannot otherwise be resolved.</p><p> </p>

star this property answer text <p>Great Western Railway offers compensation under a Traditional Passenger’s Charter and is not covered by the Delay Repay compensation scheme. Chiltern Railway also operates under a traditional Passenger’s Charter plus a limited form of Delay Repay with exclusions.</p><p> </p><p>The Department for Transport has asked a number of DfT-franchised train operating companies, including Great Western Railway, for proposals to implement Delay Repay before their contract expires and will introduce Delay Repay if the proposals are affordable and represent value for money for taxpayers. It is anticipated that Great Western Railway will introduce Delay Repay in 2019.</p><p> </p><p>Delay Repay from 15 minutes (DR15) will be included in the specification for all new DfT franchises in future. This will include the renewal of Chiltern Railway’s franchise.</p> more like this

Compensation is available to passengers with single, return and weekly season tickets as shown:</p><p>- Arriva Trains Wales, 20% for delays of 30 – 59 minutes, 100% for delays of 60 minutes or longer</p><p>- First Great Western: 100% for delays of 60 minutes or longer (High Speed services);</p><p>50% for delays of 60 minutes or longer on journeys of 60 minutes or more, and 50% for delays of 30 minutes or longer on journeys of less than 60 minutes (former First Great Western Link services);</p><p>50% for delays of 60 – 119 minutes, 100% for delays of 120 minutes or longer (former Wessex services),</p><p>- First TransPennine Express: 100% for delays of longer than 30 minutes</p><p>- Northern: 50% for delays of 60 minutes or longer</p><p>- South West Trains: 100% for delays of 60 minutes or longer except for Island Line where 100% for delays of longer than 30 minutes</p><p> </p><p>The proportion of total passengers eligible to claim compensation for delays of 30 to 60 minutes is not known, but given that compensation for delays from 30 minutes applies on the majority of TOCs, including many of the larger operators, it will be the majority.</p><p> </p><p> </p>

star this property answer text <p>Where not already in place we are introducing the Delay/Repay scheme, and other enhanced compensation regimes as new franchises are let, and as opportunities arise within existing franchises. Delay/Repay is designed to recompense customers for significant delays to their journeys, including through cancellations.</p><p> </p><p>The minimum standard for passenger compensation is set out in the National Rail Conditions of Carriage (NRCoC). The NRCoC are effectively the terms and conditions for rail tickets sold in Great Britain. And all Train Operating Companies (TOCs) are required under their franchise agreement to have in place a Passenger’s Charter which will include arrangements for compensation for passengers.</p><p> </p><p>In their Passenger’s Charters, most TOCs do offer more than the NRCoC minimum. TOCs can, at their discretion, go beyond the commitments in their Passenger’s Charter on an ex gratia basis.</p><p> </p><p>The Government continues to keep this under review to ensure passengers are treated fairly.</p><p> </p><p> </p>

The trial by c2c, starting in early 2016, of an automated system providing compensation for delays of between 2 and 29 minutes is very welcome, and it is exactly the kind of compensation system that puts passengers at the centre of the railway.
