star this property answer text <p>It is assumed that the hon. Member is referring to cases where administrative action was taken, under AGAI Chapter 67 or the equivalent regulations in the Naval Service and RAF, against Service personnel who had been in receipt of a simple police caution, after the amendment to the Rehabilitation of Offenders Act 1974 made by section 49 the Criminal Justice and Immigration Act which came into force on 19 December 2008. <br><br>The range of administrative sanctions which could have been applied in such circumstances is extremely wide, ranging from a formal warning to termination of service. A full analysis by year would require the examination of individual records and could only be obtained at disproportionate cost.</p> more like this

star this property answer text <p>Foreign and Commonwealth personnel with four years service in the Armed Forces service can apply, in the interim, for settlement. This process regularises their immigration status while they qualify and meet the mandated Home Office criteria to apply for citizenship. <br><br>The Ministry of Defence has completed an analysis of personnel records and I can confirm that no Foreign and Commonwealth personnel with less than four years service were made redundant since 2010. Therefore redundancy from the Armed Forces would not have prevented personnel from applying for settlement or citizenship.</p> more like this

star this property answer text <p>There are no current proposals to amend Schedule 2 of the Armed Forces Act 2006 to include the offences of sexual assault, exposure and voyeurism. A Commanding Officer made aware of an allegation that any of those three offences have been committed is under a statutory obligation to ensure it is investigated appropriately. Additional guidance, provided in the Manual of Service Law, informs Commanding Officers to take legal advice when making a decision as to who should investigate, with the presumption that the Service Police should normally be made aware.</p><p> </p><p> </p> more like this
