In preparation for a no deal Brexit, the Government prepared secondary legislation to provide for a temporary unilateral EEA exhaustion regime. The Intellectual Property (Exhaustion of Rights) (EU Exit) Regulations 2019 was approved by Parliament in February 2019. The Government also published guidance, in the form of a technical notice on GOV.UK in September 2018 for businesses and consumers to prepare for a no deal scenario. The Government continues to engage with stakeholders on this issue in preparation for a possible no deal Brexit.
