answer text <p>The Care Quality Commission (CQC) is able to check that providers are meeting the Fit and Proper Persons Requirement (FPPR), either after a notification has been received when a new board director, board member or individual who performs the functions equivalent to the functions of a board director and member director is being appointed or during an inspection of a provider, and could impose a condition on the provider to require the removal of an unfit director.</p><p> </p><p>The CQC has provided the following response:</p><p> </p><p>Assessing compliance with FPPR is an integral part of the CQC’s assessment of inspections of well-led and this is business as usual. In addition to routine assessment of providers the CQC respond to any FPPR referrals through the processes in place since the regulation came into force. The CQC will continue to operate within the current regulations and will engage fully with the review and respond to any changes in the regulation moving forward.</p><p> </p><p>The Kirkup Review, states that “a ‘just’ culture is one where openness and transparency is an essential ingredient to identify the root cause if care falls below standards, or when care doesn’t go according to plan”. The CQC’s assessments of Duty of Candour (DoC) are an integral part of assessments of well-led and the CQC continues to consider DoC as a matter of course.</p><p> </p><p>The CQC looks at DoC as part of well–led assessments and have raised the profile of DoC in their State of Hospitals and ‘Learning, candour and accountability - A review of the way NHS trusts review and investigate the deaths of patients in England’ reports. In addition, the CQC plans this year to update guidance and refresh training for inspectors in this area.</p>

answer text <p>The Liverpool Community Health Independent Review identified failures in Liverpool Community Health NHS Trust’s provision of health services to HMP Liverpool and healthcare in HMP Liverpool is currently undergoing significant review.</p><p> </p><p>Services are now in the process of being re-procured to new service specifications based on an updated Health Needs Assessment.</p><p> </p><p>Detailed improvement plans have been put in place with clear lines of accountability for delivery, as well as enhanced systems for reporting, and quality monitoring to ensure that any health care risks or incidents are escalated appropriately.</p><p> </p><p>Joint governance arrangements have been formalised between healthcare commissioners and the prison management team to oversee this work.</p> more like this

answer text <p>NHS England is taking several approaches to ensure clinical commissioning groups (CCGs) are following the Excellence in Continence Care Framework, including;</p><p>- arranging for CCGs to have access to teams of expert clinicians, commissioners from areas that have adopted the guidelines and people with experience to review their existing service against the best practice outlined in the guideline and make appropriate improvements;</p><p>- exploring the potential for a mandatory data set to provide transparency about the continence service CCGs are commissioning, via the CCG assurance process which enables NHS England to check how CCGs are meeting the health needs of their population;</p><p>- encouraging CCGs to develop integrated commissioning arrangements with local authorities to ensure improved coordination, experience and use of resources; and</p><p>- ongoing communication and education campaigns to raise awareness about the Framework.</p><p> </p><p>An updated version of the NHS England Excellence in Continence Care guidance is being developed and is due to be published in the near future. There is no confirmed date for publication at the present time.</p><p> </p><p>NHS England are exploring the mandatory data set and have a long term programme to increase the transparency of information available about the National Health Service.</p>

answer text <p>I wrote to all of the organisations set out in Section 6 of the report (NHS England, NHS Improvement and the Care Quality Commission) asking them to confirm what steps they were taking to implement the review's recommendations.</p><p> </p><p>Both my original letters and copies of the responses from NHS Improvement, the Care Quality Commission and NHS England have been shared with the Health Select Committee and are attached.</p><p> </p><p>The Department is continuing to liaise with all of the national bodies with responsibility for recommendations in the report.</p> more like this
