answer text <p>So that we might better understand the consequences of the 19 March 2014 Supreme Court judgment in the case of Cheshire West, we have asked the Health and Social Care Information Centre to perform additional data collections as to the number of Deprivation of Liberty Safeguard (DoLS) applications made and the number authorised. The first data set was published in early October 2014. The next will be published in early November 2014.</p><p> </p><p> </p><p> </p><p> </p><p> </p><p>In the meantime, to assist local authorities, the Government has commissioned the Association of Directors of Adult Social Services to review and redesign the standard forms that support the DoLS process. This will reduce bureaucracy on local authorities whilst maintaining robust safeguards for the service user.</p><p> </p><p> </p><p> </p><p> </p><p> </p><p>In addition, the Government has commissioned the Law Society to produce guidance to assist local authority DoLS practitioners (including social workers) to understand what constitutes a deprivation of liberty following the Supreme Court judgment.</p><p> </p>

answer text <p>There is no duty on the National Health Service, local authorities and education providers to hold joint registers of children with Autism Spectrum Disorders (ASDs). Following consultation by the Department of Health as part of a review of social care data, local authorities now return data on adults’ primary need for social care support and any health conditions a person may have, including autism<em>. </em>Local authorities are required to keep a register of disabled children under Schedule 2 of the Children Act 1989 and the School Census collects data on children’s type of special educational need, including ASD, which is published annually by the Department, by local authority area. ‘The Special Educational Needs and Disability Code of Practice: 0 – 25 years’ advises local authorities and health commissioning bodies to use available data such as these when carrying out their duty under the Children and Families Act 2014 to commission jointly services for children with special educational needs and those with disabilities, including children with ASDs.</p>

NHS England continues to play an integral role in the project. answer text <p>NHS England is responsible for commissioning all healthcare services for people in detention (including youth custodial establishments) in England and this will include healthcare provision for the Secure College Pathfinder.</p><p> </p><p>There will then be competition for a healthcare provider for the Secure College Pathfinder in 2015. The priority will be to secure a provider who has the expertise and experience to provide young people in custody with appropriate services to meet the specific needs of this cohort of children so they can access and receive the same quality and range of healthcare services as provided in the wider community.</p><p> </p><p>The healthcare provision at the Secure College Pathfinder will be commissioned following a Health and Well-Being Needs Assessment and in line with the Intercollegiate Healthcare Standards (June 2013).</p><p> </p> more like this

Individual contract managers would need to search through hundreds of contract files to confirm whether the clauses in each one of their contracts are on the same or a similar basis to the clauses within the draft Transforming Rehabilitation contracts.</p><p> </p><p>I can however tell you that voluntary termination is a standard clause in government contracts which is designed to provide flexibility for government while maintaining the balance of value for money for the tax payer.</p><p> </p><p>Voluntary termination compensation would only be payable to the contractor if a contract is terminated through no fault of the contractor.</p><p> </p> more like this

Decisions on the size of an Immigration Enforcement arrest team are made on a risk assessment and intelligence basis. answer text <p>National roll-out of liaison and diversion services by NHS England will follow HM Treasury approval of a full business case. It has taken time to develop the business case and it will not be complete until 2015. This is because there is no existing evidence for the effectiveness of liaison and diversion services and this has to be developed as part of the phased roll-out of liaison and diversion services.</p><p> </p><p>Information is not available about the potential number of offenders who would be affected by roll-out in 2017 instead of roll-out in 2014. Liaison and diversion services enable people entering the criminal justice system with mental health-related conditions and learning disabilities to get the right support and the best possible care as soon as possible. For offenders whose needs are not identified by a liaison and diversion service in police custody or the courts, these will continue to be identified through court procedures or at reception in prison.</p> more like this

answer text <p>We are closely monitoring the impact of the legal aid changes. The number of family cases showing self representing parties is published in Courts Statistics Quarterly (www.gov.uk/government/collections/court-statistics-quarterly).</p><p> </p><p>We are working towards publishing data on self representation in civil cases more widely and will include this in future publications.</p><p> </p><p>Litigants in person have always been a feature of the justice system.</p><p> </p><p>Judges are used to helping persons with no legal representation, including explaining procedures and what is expected of them. We have taken steps to help people who either want or have to represent themselves in court, including publishing a revised guide for separating parents and increased training for judges.
