answer text <p /> <p>As of 30 September 2014, there have been:</p><p> </p><p>a) 173 applications to the Diffuse Mesothelioma Payment Scheme</p><p>b) 88 payments made</p><p>c) 28 unsuccessful applications</p><p> </p><p>The average payment as of 30 September 2014 is £125,000 (rounded to the nearest £1,000). Due to the low numbers of the Scheme applications at this stage, it is not possible to disclose the actual highest and lowest payments, as they could lead to individuals being identified.</p><p> </p><p>DWP will carry out an annual review of the scheme as set out within the Diffuse Mesothelioma Payment Scheme Regulations 2014. The first report under this regulation will be published on or before 30 November 2015. The report will set out the objectives intended to be achieved by the scheme, include the level of take up, and assess the extent to which those objectives have been achieved over the reporting period.</p> more like this

This figure is derived from £8,633,440.75 total paid to applicants and £2,380,253.73 total paid to the DWP Compensation Recovery Unit (CRU). DMPS payments are subject to recovery following benefit legislation which provides for CRU to recover social security benefits and lump sums that were paid for the same condition.</p> more like this

answer text <p /> <p>Legal aid for personal injury claims including mesothelioma was withdrawn by the last Government in April 2000 as conditional fee agreements (CFAs) were available. This Government has since reformed the way in which CFAs operate, but its decision to apply those reforms to mesothelioma cases was recently overturned by the High Court. The Government is considering the way forward in the light of that judgment.</p> more like this

answer text <p /> <p>The Scheme began taking applications in April 2014, and began making payments on 1 July 2014. As of 30 September 2014 the Scheme had received 173 applications. During the first year of operation we had forecasted around 900 applications to the Scheme.</p><p> </p><p>The DMPS is funded by a levy on the insurance industry. The levy is intended to cover the cost of the Scheme in any one year, and we are not expecting to generate any under spend. Any under spend would be returned to HM Treasury.</p><p> </p> more like this
