As set out in the letter to the Committee of 12 November, the department initially excluded all individuals with a “criminal case type” marker. We reviewed this approach to ensure we have not adopted too broad a definition and revised our methodology. answer	answer is ministerial correction date of answer 05/09/2018 answer text <p>The Home Office held a contract with Capita from October 2012 to October 2016, to establish contact with individuals who were in the Migration Refusal Pool, which is a pool of records of those who have applied to remain in the UK but had not obtained any leave.</p><p>Those individuals who had been refused leave to remain in the UK, had their existing leave curtailed or had an application or representations rejected, were contacted by Capita to discuss the options open to them. The data for the individuals to be contacted was supplied to Capita by the Home Office.</p><p>More information about review of historical removals and detentions dating back to 2002 who might have been part of the Windrush generation, is set out in the second monthly update provided by the Home Secretary to the Rt Hon Yvette Cooper MP on 21 August 2018. answer	answer is ministerial correction date of answer 10/10/2018 answer text <p>The Department has been carrying out a review of all cases of Caribbean Commonwealth nationality, born before 1 January 1973, who have been removed and/or detained by the Home Office since 2002 (when the Casework Information Database (CID) was available across the immigration system) and sought to identify any individuals where there was an indication in the record that the individual could have been in the UK before 1973.</p><p>The Home Secretary wrote to the Chair of the Home Affairs Select Committee on 21st August to provide an update on this work. This letter outlined that, so far, this review has identified 164 people who were detained and / or removed who told the Home Office they came to the UK before 1 January 1973. Of these, we have identified 18 people who stayed here permanently and who are the people we consider most likely to have suffered detriment because their right to be in the UK was not recognised and where the Department is most likely to have acted wrongfully in removed or detaining them. Eleven of these left the UK voluntarily and seven were detained. Letters of apology are being sent from the Home Secretary.</p><p>A copy of this letter has been deposited in the House Library. This work is ongoing and the Home Secretary has committed to regularly updating the Home Affairs Select Committee on progress.</p><p>These cases of removal and detention have happened over many years under successive governments, with cases spread roughly equally between 2002-2010, and from 2010 onwards. answer	answer is ministerial correction date of answer 21/05/2018 answer text <p>The Home Office has been checking around 8,000 records of removals and deportations dating back to 2002 to determine whether there have been any wrongful removals or deportations of Caribbean nationals who arrived before 1973.</p><p>Of these 63 cases have been identified where the individual could have entered the UK before 1973. This is split between 32 Foreign National Offender deportations and 31 administrative removals.</p><p>We are now reviewing each of these cases carefully in more depth - including bringing paper files out of storage if necessary - to determine whether anyone who was protected under the 1971 Act was removed or deported unlawfully. This work will be independently assured.</p><p>This does not mean that 63 people have been wrongfully removed or deported.
