answer text <p>The Information Commissioner’s Office (ICO) is responsible for regulating the UK’s data protection legislation and has a range of criminal and civil enforcement tools at its disposal. People can already complain to the ICO about the way an organisation has handled their personal information. In response to a complaint the ICO may make recommendations to the organisation to put things right or to improve their practice. The UK legal system also provides for independent judicial remedies. People may seek a judicial remedy from the start, or they may proceed to court after having already complained to the ICO. They may also in some instances seek a judicial remedy against the ICO or lodge a complaint in relation to its activity.</p> more like this

answer text <p>DWP takes data protection and all data breaches extremely seriously. The Department demands a high standard from any of its appointed agents. It is also standard practice to undertake tailored awareness sessions for colleagues on data protection and data breaches.</p><p>Our Security and Data Protection Team works closely with commercial colleagues to ensure that the relevant security and data protection clauses are contained in all contracts. In addition, DWP has Supplier Assurance Teams that undertake regular pre and post contract checks on suppliers to ensure they are meeting their obligations under the terms of the contract. The Department regularly undertakes trend analysis and lessons learnt exercises on data breaches if they do occur. Recommendations are implemented and communicated to all relevant parties.</p> more like this

answer text <p>The UK’s data protection legislation is now set out in the Data Protection Act 2018 and UK General Data Protection Regulation. Like the previous legislation, consent is not the only lawful ground on which processing of personal data can occur. For example, it might be necessary for organisations to process data for public interest reasons, such as crime prevention or safeguarding, without seeking the consent of the individual first. Similarly, there may be some non-intrusive commercial activities that customers may reasonably expect organisations to take without seeking their specific consent.</p><p>We are taking steps in the Data Protection and Digital Information (No. 2) Bill to reform aspects of the current legislation. Where processing of personal data is based on a person’s consent, the Bill will not make any changes to the rules which require consent to be freely given, specific and informed. The Bill will make some changes to existing record-keeping requirements which can place unnecessary burdens on small businesses in particular. In the future, organisations will only have to keep records of their processing activities if their processing activities are likely to pose high risks to the rights and freedoms of individuals. This will help to make sure that organisations are not spending disproportionate amounts of time and resources on unnecessary paperwork.</p>

answer text <p>Articles 13 and 14 give data subjects the right to be informed about the collection and use of their personal data. Article 13 and 14 already stipulate that controllers must include (i) information about the purposes of the processing for which the personal data are intended as well as the legal basis for the processing, and (ii) information about the rights available to the data subject in relation to their information, such as the rights of access, rectification and erasure.</p><p>Article 12 of the UK GDPR states that the information provided in Articles 13 and 14 must be provided in a ‘concise, transparent, intelligible and easily accessible form, using clear and plain language’. Additionally, Article 12 makes provision for this information to be provided in a variety of formats, rather than a single, standard format (‘the information shall be provided in writing, or by other means, including, where appropriate, by electronic means’).</p><p>The Information Commissioner’s Office (ICO) provides detailed guidance on the right to be informed. This guidance sets out that it is most effective to provide information to data subjects using a combination of different techniques including layering, dashboards, and just-in-time notices. The guidance also provides advice for controllers on what to consider when presenting this information to a data subject.
