Therefore reporting and subsequent referral and direction to trial may not all take place in the same calendar year. Furthermore, the figures for cases reported to the RMP may include some incidents which have been reported for information purposes only, which are within the jurisdiction of the civilian police to investigate.</p><p> </p><p> </p><p>Rape statistics are offences and attempted offences as defined by Section 1 of the Sexual Offences Act 2003.</p><p> </p><p>Sexual Assault statistics are offences and attempted offences as defined by Section 2 and 3 of the Sexual Offences Act 2003 (Assault by Penetration and Sexual Assault).</p><p> </p><p>The RMP refer cases to both the SPA and a Commanding Officer (CO). All offences under Section 1 and 2 of the Sexual Offences Act 2003 are referred directly to the SPA. Offences under Section 3 of the Sexual Offences Act 2003 are referred to a CO. The table above does not include referrals to the CO.</p><p> </p><p>Domestic violence is not a crime classification, but may be recorded under the crime classification of violence, for example, assault, battery or grievous bodily harm. For the RMP to establish which offences are as a result of domestic violence would require an individual review of all cases, which could be provided only at disproportionate cost. SPA figures for Domestic Violence are only available from 2010 when the SPA started to record Domestic Violence as a separate offence.</p><p> </p><p>These are not designated Official Defence Statistics.</p>

answer text <p>The Ministry of Defence takes any allegation of rape, sexual assault or domestic violence seriously. Allegations of rape, sexual assault or domestic violence in the Armed Forces can be reported to either the Service or the civilian Police Forces.</p><p>If a Commanding Officer is made aware of an allegation against a person subject to Service law or a civilian subject to Service discipline, or circumstances contained within the Armed Forces Act 2006, Schedule 2 (which includes the offences under Section 1 and 2 of the Sexual Offences Act 2003 (rape and assault by penetration)), he must as soon as reasonably practicable ensure that the Service Police are made aware of the matter.</p><p>If the allegation does not fall within Schedule 2, the Commanding Officer is still under a statutory obligation to ensure that the matter is investigated in such a way and to such an extent as is appropriate or ensure that, as soon as practicable, the Service Police are aware of the matter.</p> more like this

answer text <p>All allegations of rape, sexual assault and domestic violence made by or against members of the Armed Forces are thoroughly investigated. An investigation may be conducted by either the civil or Service Police.</p><p> </p><p>The tables below show the number of alleged cases of rape and sexual assault (including assault by penetration) that were investigated by each branch of the Service police in each year from 2009 to 2013, the number referred to the Service Prosecuting Authority (SPA) and the result of those referrals. The SPA can receive formal referrals only from either Service Police or the Commanding Officer.</p><p>It should be noted that the SPA may receive referrals in one year which relate to allegations and investigations made in previous years and that such cases may be directed, disposed and/or tried in following years. battery, assault or grievous bodily harm.
