answer text <p>The EU’s adequacy assessments, underway since March 2020, ascertain whether UK data protection standards are ‘essentially equivalent’ to the EU’s. Given we have an existing data protection framework that is equivalent to the EU’s, we see no reason why the UK should not be awarded adequacy and we expect the process to be concluded promptly.</p><p>The EU left insufficient time to adopt data adequacy decisions before the end of the transition period. We have therefore agreed with the EU a time-limited ‘bridging mechanism’ which will allow personal data to continue to flow as it did previously whilst EU adequacy decisions for the UK are adopted. In practice, we do not expect the bridging mechanism to be in place for more than 4 months, which is when the bridge is envisioned to expire, but there is scope to extend it to 6 months if required. As stated above, given the UK has an existing data protection framework that is equivalent to the EU’s, we see no reason why the UK should not be awarded adequacy in this timeframe.</p><p> </p>

answer text <p>At the end of the transition period EU data protection legislation generally ceased to apply in the UK and the Information Commissioner’s Office (ICO) is no longer part of the EU's General Data Protection Regulation (GDPR) One Stop Shop (OSS) mechanism. The ICO will continue to cooperate and collaborate with European supervisory authorities regarding any breaches of GDPR that affect individuals in the UK and other EU and EEA states.</p><p>It is in our mutual interests to establish a shared approach for regulatory cooperation on data protection issues with the EU. Having secured a commitment to regulatory cooperation on data protection in the Trade and Cooperation Agreement (TCA), we are working to further develop and implement these arrangements.</p><p>Guidance is available on the ICO website.</p><p> </p><p> </p> more like this

answer text <p>Tech Nation is committed to improving diversity and inclusion within the tech sector. Within their growth programmes, the percentage of non-London companies they support has risen from 32% to 68% since 2018 and they have been collecting ethnicity data from applicants since 2020.</p><p>They have also taken a proactive stance on improving representation in the sector through a number of initiatives such as the successful ‘female founder hours’, improving inclusivity of online resources and developing a diverse speaker database.</p><p>Their annual Tech Nation Report has included detailed diversity statistics on the UK tech sector since the organisation was established in 2018 and they released their Diversity &amp; Inclusion Report in 2019 which delved deeper into this topic.</p><p>For the past two years, they have collaborated with the TechTalent Charter on the data collection which supports their work driving inclusion and diversity in tech recruitment. They have partnered with Extend Ventures in a research capacity for their in-depth report, Diversity Beyond Gender. They have also acted as a delivery partner with OneTech - an organisation dedicated to challenging inequity in the digital sector.</p><p>Tech Nation are committed to fostering a culture of inclusivity within their organisation and to implementing diverse hiring practices, including using job boards such as Black Young Professionals Network and Disabilities Jobsite UK. They are also currently collecting thorough diversity data internally. This uses a newly-developed framework which they then plan to extend to cohort companies and the wider industry, via an external toolkit.</p><p> </p>

answer text <p>The Department for International Trade (DIT) has a 2 key information gateways in place. One with the HM Revenue and Customs (HMRC) and one with the Office for National Statistics (ONS).</p><p>DIT has a legal gateway to receive and access HMRC data via a Memorandum of Understanding. This has been granted under sections 18 of the Commissioner for Revenue and Customs Act 2005 and section 25 of the Taxation (Crossborder Trade) Act 2018. This gives DIT access to HMRC data including (but not limited to) Customs Declarations data with Director level sign-off for the monitoring and investigation of unfair trade. Access is limited to colleagues in the Trade Remedies Investigations Directorate that provide digital and operational support to the directorate. The movement, use and destruction of the data must be in line with HM Government’s Security Policy Framework.</p><p>The Trade (Disclosure of Information) Act 2022 underwent Royal Assent in December 2020. The Act includes a data sharing clause that allows DIT (and other departments) the opportunity to request data held by HMRC for the purposes of trade. We are currently working closely with HMRC to agree what data can be shared, how it will be shared and held safely on DIT systems and agree protocols on data usage.</p><p>DIT also has 4 Data Access Agreements in place with the ONS. This gives access to: the Inter-Departmental Business Register, the Labour Force Survey, the Annual Population Survey and Annual Survey of Hours and Earnings to approved individuals in this agreement for the purposes specified within the agreements. Access is restricted to approved individuals via an agreed secure analytical environment and managed by the DIT Microdata team. Records are kept of users and their access arrangements as well as the work that they are undertaking and outputs produced. The processing of these data must be for statistical purposes and in accordance with Data Protection Legislation including the Data Protection Act (1998) and the Statistics and Registration Service Act (2007). All outputs must meet the criteria and Principles established in the Code of Practice for Official Statistics set out by the UK Statistics Authority (UKSA).</p><p>Finally, over the summer DIT supported HMRC and other departments with engagement with businesses for the end of transition, with a Memorandum of Understanding to cover data sharing. This included using data provided by HMRC, the legal basis for which was Commissioners for Revenue and Customs Act Section 18(2) with trader consent. This work is now complete.</p><p> </p>
