	answer	answer is ministerial correction date of answer 01/08/2019 answer text <p>The sale of wearable GPS tracking devices, including where they are sold to assist with the care of dementia patients, is subject to UK consumer protection legislation. This legislation includes the Consumer Rights Act 2015 under which all goods and services must be of satisfactory quality and fit for purpose.</p><p> </p><p>In addition, all personal data collected by GPS devices is subject to the EU General Data Protection Regulation (GDPR) and the Data Protection Act 2018 which is regulated by the Information Commissioner's Office (ICO). This legislation provides that any data collected must be processed transparently, fairly and for legitimate purposes. Companies developing new technologies which are likely to result in a risk to the rights and freedoms of data subjects are also required to complete a Data Protection Impact Assessment before the processing begins. In these instances, the company will be required to consult the ICO if their assessment indicates the processing would result in a high risk in the absence of any mitigating actions.</p><p> </p><p>As GPS tracking is used for a wide range of applications, there are also some cases where other regulations may apply. For example, Section B of the Bail Act 1997 includes provisions in respect of electronic monitoring of people on bail.</p><p> </p><p>The Government is committed to supporting the responsible use of technology to improve people's lives, including supporting its use to help vulnerable people like dementia patients. The Medical Research Council, the Alzheimer's Society and Alzheimer's Research UK are jointly investing £290 million in the UK Dementia Research Institute at Imperial College London which looks at technology solutions that can assist people with dementia in their homes. Our Industrial Strategy also includes the Ageing Society Grand Challenge through which the Government will invest in the further development of technologies like Artificial Intelligence and the Internet of Things with the aim that people can enjoy at least five extra healthy independent years of life by 2035.</p><p> </p><p>The Government also recognises the importance of ensuring that regulation is able to keep pace as technology advances. On 11th June, we published our White Paper on Regulation for the Fourth Industrial Revolution. Our Domestic Abuse Bill and wider action plan will help to ensure that victims have the confidence to come forward and report their experience, safe in the knowledge that the justice system and other agencies will do everything they can both to protect and support them and their children and pursue their abuser.</p><p>We will consider the findings of the report. In health education, there is a strong focus on mental wellbeing, including a recognition that mental wellbeing and physical health are linked. Emotional literacy at primary and secondary levels is included throughout all 3 subjects, and particularly when covering topics on mental health and wellbeing.</p><p> </p><p>Schools have flexibility to design and plan age-appropriate subject content. In health education, the guidance sets out core areas for health and wellbeing for primary and secondary aged pupils; including topics such as mental wellbeing, physical health and fitness, healthy eating, harmful substances, health and prevention and basic first aid.</p><p> </p><p>The department is currently working with teachers and schools to determine how support and training for these subjects should be structured. Our programme of support will focus on tools that improve schools’ practice, such as implementation guidance and targeted support; training materials; and resources that teachers need to teach the new subjects effectively.</p><p> </p><p>To provide further support for schools to build the capability to identify and promote awareness of mental health needs, the government committed in January 2017 to make available mental health awareness training to one member of staff in all state secondary schools by 2020, and all state primary schools by 2022. The 3 year secondary schools’ mental health awareness training programme started in 2017 and was delivered for the first 2 years by Mental Health First Aid England. In 2019, the Department of Health and Social Care (DHSC) and the Department for Education (DfE) announced that the final year of the secondary school mental health training programme will be delivered by the Anna Freud National Centre for Children and Families. The DHSC are currently considering options on how best to deliver the mental health awareness training in primary schools.</p><p> </p><p>The DfE is currently recruiting a provider to develop and deliver a new mental health training programme for senior mental health leads in schools and colleges. We expect to be able to announce the outcome of this process in 2020. In 2018, 82% of schools and 91% of further education colleges had a mental health lead.</p><p> </p><p>The department is supporting the uptake of senior mental health lead roles by providing training. Subject to contract procurement, this training will be available from June 2020 and available to all state-funded schools and colleges by 2025. The precise level of commitment to complete training will be determined during the development of the training, shaped by the needs of senior leads.</p><p>Training will be prioritised in the first instance within schools and colleges selected to work with Mental Health Support Teams, which were chosen as part of the commitments made by the government in its response to ‘Transforming Children and Young People’s Mental Health: A Green Paper’, attached. We welcome that both the All England Lawn Tennis Club and The Rugby League World Cup 2021 have done so. We set our assessment providers challenging targets and monitor performance closely against a range of measures including through independent audit to improve accuracy and decision making. Contractual remedies are in place if assessment providers fail to deliver against the service standards.</p><p>Contractual remedies for underperformance against a range of service levels are recovered through service credit mechanisms and through deductions of payments (a ‘No Pay’ mechanism).
