unstar this property answer text <p>Government Departments continue to engage with a wide range of businesses to understand their priorities and issues as we leave the European Union, both to inform our negotiating position, and our preparations in the unlikely event of there being no deal.</p><p> </p><p>Departments can make use of non-disclosure agreements (NDAs) when structuring their engagements on preparations for leaving the EU, which is a crucial component of planning. It is for departments to determine the manner in which engagement with stakeholders takes place. Given the sensitive nature of some discussions, there may be limited circumstances in which departments have used NDAs to enable those conversations, thereby reaching more stakeholders than would otherwise be the case.</p><p> </p><p>NDAs are also a common component of contractual arrangements that are used to protect commercial considerations of the parties involved or to protect sensitives around the development of Government policy.</p><p> </p><p>It is entirely normal practice to use such agreements and they are therefore sometimes necessary for Government departments who are responsible for managing their preparations for leaving the EU.</p>

Confidentiality requirements are a common element of contractual obligations and are used by departments to protect commercial considerations; to reflect the sensitive nature of some discussions; and to facilitate conversations that otherwise may not have been able to take place, due to concerns around sensitive information.</p><p> </p><p>The requested information on the number of NDAs is not held centrally by Defra and could not be provided without incurring disproportionate cost.</p> more like this

unstar this property answer text <p>Government departments make use of non-disclosure agreements (NDAs) when structuring their engagements on preparations for leaving the EU, which is a crucial component of planning. It is for departments to determine the manner in which engagement with stakeholders takes place.</p><p>Given the sensitive nature of some discussions, there may be limited circumstances in which departments have used NDAs to enable those conversations, thereby reaching more stakeholders than would otherwise be the case.</p><p>The department has put a limited number of NDAs in place in the course of its work. The use of NDAs is limited to standard contractual arrangements with those providing services to support our work and are necessary to protect commercial considerations.</p><p>According to central records, the department has seven current NDAs covering standard contractual arrangements with providers for activity including media monitoring, consultancy and research.</p><p> </p> more like this

Any non-disclosure elements in commercial agreements or procurements form part of the overall agreement or process and are not NDAs in their own right.</p><p>The Commercial Directorate have not issued specific EU Exit-related policy to include NDAs within contracts. This means that depending on the type of engagement with suppliers, NDAs will have been issued as relevant, as part of the process but there has been no policy of issuing NDAs just because the work was EU Exit related.</p> more like this
