	answer	answer is ministerial correction date of answer 14/09/2017 answer text <p>The assessment for Personal Independence Payment (PIP) is designed to treat people as individuals, considering the impact of their impairment or health condition on their everyday life and how each claimant has personally adapted to living with a disability, whether or not medication is prescribed or used. The PIP assessment is not a medical assessment, requiring the Health Professional to diagnose a condition or its severity and recommend treatment options; instead it focuses on the claimant’s functional ability.</p><p>There is no automatic entitlement to PIP by virtue of a health condition (except in terminal illness cases), either for new claimants or those claimants who were in receipt of Disability Living Allowance and who are being reassessed under PIP.</p><p>The PIP Assessment Guide for Health Professionals includes guidance on the assessment criteria and how they should be applied. We have no plans to require employers to issue such statements.</p><p> </p><p>Employers who sponsor defined benefit (DB) pension schemes are not required to issue annual pension statements, although some sponsors do. However if a statement is requested by a member sponsors of DB schemes are required to issue one within two months.</p><p> </p><p>As defined benefit (DB) pensions normally promise a specific income in relation to salary and length of service, there are minimal annual fluctuations in entitlement. Placing a legal requirement on DB schemes to issue annual statements, particularly where the estimated pension remains unchanged, would place a disproportionate cost burden on defined benefit schemes. To do this requires an approach that goes beyond the safety net of the welfare state to tackle the root causes of poverty and disadvantage. This is why the income-related targets and the requirement to publish a child poverty strategy set out in the Child Poverty Act 2010 have been repealed. In their place, we have introduced statutory measures to drive action on parental worklessness and children’s educational attainment – the two areas that we know can make the biggest difference to disadvantaged children.</p><p> </p><p><em>Improving Lives: Helping Workless Families</em>, published on 4 April, set out a framework for a continued focus on improving children’s outcomes, now and in the future. It introduced seven non-statutory indicators and underlying measures to track progress in other areas, such as parental conflict, problem debt and homelessness, that are important in tackling the disadvantages that can affect families’ and children’s outcomes.</p><p><br>The Government has a statutory duty to report annually to Parliament on parental worklessness and children’s education attainment. Each agreement will set out relevant conditions to protect the Secretary of State’s interests in the English component of the franchise (including the English component of cross-border services). The CAA offers advice to passengers and is able to take enforcement action against airlines that are not fulfilling their obligations.</p><p> </p><p>In addition, the Government and the CAA, have introduced an Alternative Dispute Resolution (ADR) scheme into the sector, which now covers more than 70% of passengers.</p><p> </p><p>The provision of ADR services for consumer disputes stemming from contracts for aviation services is designed to benefit consumers and lead to quick, fair, low cost (if not free) and binding solutions to their problems. This was extended to under 18 year olds in January 2017, and will be rolled out nationally for all vulnerable witnesses in a phased approach from this autumn. 	answer	answer is ministerial correction date of answer 14/09/2017 answer text <p>In separate meetings on 2 March 2017 Ministry of Justice officials met with the Association of British Insurers and then with the Association of Personal Injury Lawyers to discuss issues arising from the Written Ministerial Statement about the personal injury discount rate made by the then Lord Chancellor on 27 February (http://www.parliament.uk/business/publications/written-questions-answers-statements/written-statement/Commons/2017-02-27/HCWS503).</p><p> </p><p>The department has not had any other meetings with representatives of the insurance industry or the victims of accidents to discuss changing how the personal injury discount rate is to be set since 7 December 2016 when the then Lord Chancellor announced her intention to complete the then current review of the rate by 31 January 2017. Officials from the Ministry of Justice have, however, been present at meetings since that date with insurer and claimant interests on other subjects at which the subject of the discount rate has been raised, including a meeting with insurers and representatives of the insurance industry chaired by the Chancellor of the Exchequer on 28 February (https://www.gov.uk/government/news/chancellor-meets-insurance-sector-leaders-to-discuss-personal-injury-discount-rate).</p><p> </p><p>The proposed changes to the way in which the discount rate is set could potentially affect the size of all lump sum awards of personal injury damages for future pecuniary loss. The size of the change would depend on the rate set and the composition of the award in question. The potential effect of the changes is analysed in the impact assessment published alongside the Command Paper <em>The Personal Injury Discount Rate How it should be set in future Draft Legislation </em>(Cm 9500).
