Regulations 5 and 8 make clear that the Human Fertilisation and Embryology Authority must make a determination in each individual case that there is a significant risk of serious mitochondrial disease. The Explanatory Note accompanying the draft Regulations laid before Parliament give further explanation of Regulations 11 to 18.
