answer text <p>All cases of misconduct must be dealt with promptly. DWP’s discipline policy follows the wider Civil Service model policy and is explicit that anyone involved in a discipline case must maintain confidentiality throughout the investigation process and after the matter has concluded. All information relating to a case is confidential and must only be seen by the relevant people as required by the discipline process.</p><p> </p><p>The Government Internal Audit Agency’s Counter Fraud &amp; Investigation (CF&amp;I) team investigates allegations of serious offending by DWP staff, which may result in warnings, dismissal, or criminal proceedings. CF&amp;I also investigates allegations of fraud and irregularities by the department’s contractors.</p><p> </p><p>Access to investigation records is limited to CF&amp;I staff with a business need and all staff must adhere to the GIAA Code of Conduct and data protection laws. Should the investigation progress to interview, individuals (including witnesses) are advised that all information relating to the investigation and any subsequent disciplinary process is confidential. Those involved in an investigation should not discuss or share information about the case except in specified circumstances.</p><p> </p><p>Confidentiality is crucial and anyone not complying with this requirement or discussing a case without authorisation may themselves to subject to disciplinary action.</p><p> </p><p>An independent Decision Maker in DWP receives a final investigation report, which should remain confidential and only be shared with relevant managers and individuals. Personal data of third parties is protected by redacting it to prevent identification.</p>

answer text <p>DWP follows the: <a href="https://assets.publishing.service.gov.uk/government/uploads/system/uploads/attachment_data/file/817156/Cabinet-Office-guidance-on-settlement-agreements-special-severance-payments-on-termination-of-employment-and-confidentiality-clauses.pdf" target="_blank">Cabinet Office Guidance on Settlement Agreements, Special Severance Payments on Termination of Employment and Confidentiality Clauses</a>, launched in 2015 and revised in 2019. The Government is clear that confidentiality clauses should not be used to prevent staff from raising or discussing allegations of bullying, harassment or discrimination.</p><p><strong> </strong></p><p>DWP does not hold confidentiality agreement data between the periods 1 January 2010 and 31 March 2020 but has been reporting this information to the Cabinet Office annually since 1 April 2020 following the revision to the guidance. DWP has not agreed any non-disclosure or other confidentiality agreements in the financial years ending April 2021 and April 2022, nor the current financial year to date.</p>

Within DWP, we encourage this and a Whistleblowing Policy is already published on the Department’s Intranet and is accessible by all employees. answer text <p>In February 2015, Cabinet Office published new guidance on non-disclosure agreements. This guidance requires a minister to approve the use of a non-disclosure agreement, and for government departments to hold a record of using such agreements.</p><p><strong> </strong></p><p>DWP has not entered into any non-disclosure agreements in the four years since February 2015 and our policy is not to use these agreements.</p><p> </p><p>Prior to February 2015, DWP did not centrally hold a record of the use of non-disclosure agreements and the information could only be provided at disproportionate cost.</p> more like this
