answer text <p>HM Treasury launched a call for evidence on the regulation of pre-paid funeral plans in June 2018. The call for evidence has confirmed that consumer detriment is present in the pre-paid funeral plan sector and that there is broad demand for the sector to come under compulsory regulation.</p><p> </p><p>Consequently, the government intends to bring the pre-paid funeral plan market within the remit of the Financial Conduct Authority and is currently consulting on the proposed legislative framework to implement this proposal. This will allow the FCA to establish a robust regulatory regime which will apply to all funeral plan providers, and improve protection for consumers.</p> more like this

answer text <p>In June 2018, the CMA launched a market study into the funeral sector. The CMA investigated two core areas in connection to the supply of a funeral: (1) how competition between funeral directors works and transparency issues in the provision of funerals; and (2) how competition works in the crematoria segment of the industry. In light of the findings of the market study, the CMA launched a full market investigation into the funeral sector. The scope of the CMA’s market investigation includes the funeral services supplied by funeral directors arising from the redemption of funeral plans.</p><p> </p><p>HM Treasury launched a call for evidence on the regulation of pre-paid funeral plans in June 2018. The call for evidence has confirmed that consumer detriment is present in the pre-paid funeral plan sector and that there is broad demand for the sector to come under compulsory regulation. Consequently, the government intends to bring the pre-paid funeral plan market within the remit of the Financial Conduct Authority and is currently consulting on the proposed legislative framework to implement this proposal.</p><p> </p><p>My officials have engaged with the CMA to ensure the respective investigations are complementary and coherent.</p>

answer text <p>The government launched a call for evidence on the regulation of pre-paid funeral plans in June 2018, having concluded that the current framework of self-regulation is not sufficient to ensure the fair treatment of consumers, and a more robust regulatory regime is needed.</p><p> </p><p>The call for evidence was launched in order to aid in the design of a more appropriate regulatory framework and noted that government’s initial preferred approach is to bring all funeral plan contracts into the scope of FCA regulation.</p><p> </p><p>HM Treasury has now analysed the submissions to the call for evidence on pre-paid funeral plans and is currently reviewing the available policy options.</p> more like this

answer text <p>The Funeral Planning Authority regulates 95% of the market. The FPA reviews registered providers’ compliance with its code of practice and has the power to terminate membership or levy a fine of up to £5,000 should a firm fail to adhere to its principals. These powers have never been used. Moreover, the voluntary nature of the FPA’s jurisdiction means it cannot prevent firms from trading, and that some firms are currently operating outside of regulation entirely. Where things do go wrong, consumers do not have access to adequate redress or arbitration services.</p><p> </p><p>HM Treasury has conducted meetings with several market participants who have indicated that the current framework of self-regulation is insufficient. Citizens Advice Scotland and Fairer Finance have published reports which analyse the pre-paid funeral plan market. The reports highlight numerous failings in the sector including a lack of clarity for consumers and high pressure and misleading sales activity.</p><p> </p>
