answer text <p>In 2023, the Government passed the Seafarers’ Wages Act to address this issue. Based on data and assumptions used in the Seafarers’ Wages Act 2023 impact assessment (https://assets.publishing.service.gov.uk/media/62e2aa8ed3bf7f75af0923d5/seafarers-wages-impact-assessment.pdf), the Government’s most recent estimate is that 4,400 individuals working on services in scope of the Act (i.e. those working on international services calling at a UK port at least 120 times a year) may be being paid less than the UK national minimum wage. The secondary legislation that the Department is consulting on currently will bring the Act into force to address this issue.</p> more like this

answer text <p>While the majority of the work of the ILO is agreed on a tripartite basis between governments and social partners, the Joint Maritime Committee (JMC) is a bipartite meeting between the social partners only.</p><p> </p><p>The sub-committee of the JMC on wages met in Geneva recently and agreed to raise the International Labour Organization (ILO) minimum basic wage guidelines for an able seafarer.</p><p> </p><p>Therefore before the government addresses the Office of the ILO, it is waiting for the recommendations of the Committee and of the amendments agreed to the Maritime Labour Convention by the Special Tripartite Committed to be adopted at the 346th session of the ILO Governing Body later this year and for the final reports of both Committees to be published.</p><p> </p> more like this

answer text <p>We will be taking action to defend the rights of British workers and we will be encouraging workers themselves to take action under the 1996 Employment Rights Act. Colleagues at BEIS will be able to offer further insight on the legal action to be taken.</p><p> </p><p>The Government is strongly committed to the welfare and protection of workers’ rights.</p><p> </p><p>Already we have strengthened the minimum wage to apply to all seafarers ordinarily working in our territorial waters - regardless of their nationality and regardless of where the vessel they are working is registered.</p><p> </p><p>Furthermore, on 30 March 2022 the Transport Secretary announced a nine-point plan to Parliament to ensure there is no repeat of P&amp;O ferries actions.</p><p> </p><p>1. Changing the law so that seafarers are paid at least the minimum wage.</p><p> </p><p>2. Writing to ports to request they bar access to ferry operators which do not pay the minimum wage.</p><p> </p><p>3. Working with international partners to create minimum wage corridors.</p><p> </p><p>4. Stepping up enforcement by asking HMRC to investigate the maritime sector.</p><p> </p><p>5. Requiring the Maritime and Coastguard Agency to step up and review their enforcement policies.</p><p> </p><p>6. Financially penalising companies which use fire and rehire.</p><p> </p><p>7.
