answer text <p>In all cases, HS2 Ltd seeks to provide compensation in as timely a manner as possible. And the focus of the Department for Transport has always been on devising policies to ensure that transactions are progressed promptly. For instance, the streamlined residential blight (SRB) scheme was introduced to provide a quicker route for property owners to sell their home as the process does not require negotiation on the property value and disturbance items. answer text <p>Policy changes are a common feature of Government and there is no mechanism or precedent for compensating local authorities or councils for abortive costs incurred as a result of changes in Government policy. Providing compensation in this instance would create wide-ranging and repercussive consequences for the taxpayer. Whilst abortive costs are unfortunate, they should be seen in the context of a broader package of support for local authorities that the Government is providing through Network North. For instance, a new £2.5 billion fund for local transport across all areas in the North outside the six city regions – smaller cities, counties, towns and countryside and as well as a new £3.3 billion fund for road resurfacing in the North.</p><p> </p><p> </p> more like this

answer text <p>a) HS2 Ltd follows the statutory process for determining compensation under statutory blight in line with other Acquiring Authorities. In practice, the Acquiring Authority and claimant each appoint a surveyor to assess the unblighted market value of the property and the disturbance compensation. Each valuer will look at comparable property transactions and value the property disregarding the underlying scheme for which the CPO powers exist. The valuers will discuss their valuations, comparables and methodologies to explore the potential to reach an agreement. Where agreement cannot be reached, the Compensation Code provides for disputes as to the level of compensation to be determined by the Upper Tribunal (Lands Chamber).</p><p> </p><p>b) For the discretionary schemes introduced by the Secretary of State, the valuation approach is set out in published guidance and provides for each party to commission a valuation from a Registered Valuer. Where the two valuations are within 10% of each other (calculated by taking the difference between the two values as a percentage of the higher value) the Secretary of State will offer a price that is the average of the two valuations. If the valuations differ by more than 10% (calculated as above) an additional valuation will be obtained from HS2 Ltd’s pool of valuers (chosen by the applicant). The third valuer will be provided with the previous reports for consideration, with the valuation figures themselves removed. The offer will be made on the average of the closest two valuations.</p><p> </p><p> </p>

answer text <p>One of the Government’s key objectives for the HS2 programme is to deliver a step- change in HS2 Ltd’s performance and to drive improvements in transparency and accountability. Central to that ambition is to place people - the communities, individuals and businesses who are being impacted by the new railway - at the heart of everything the Government does.</p><p> </p><p>It is inevitable that a project the size and scale of HS2 will be disruptive to people who face losing their homes, relocating their businesses or having their community disrupted during construction and the future operation of the railway.</p><p> </p><p>The Government has already introduced a range of property compensation schemes that seek to strike a sensible balance between supporting those affected and protecting the public purse. Nevertheless, the Government is determined to ensure those people and businesses are supported, fairly compensated, and treated with compassion, dignity and respect.</p><p> </p><p>I therefore commissioned a review in May of the HS2 land and property acquisition programme. This review is examining HS2 Ltd’s land and property acquisition processes and, where the evidence demonstrates it, associated wider-government policies. It is looking at what can be done to streamline claims and payments to remove unnecessary delay and frustration for people who are giving up land for the scheme.</p><p> </p><p>Work on the review has involved close joint-working between the Department and HS2 Ltd, and engagement with numerous stakeholders, including all line of route MPs. The Government expects the review to conclude shortly. A copy of the final report and proposals for change will be placed in the Libraries of the Houses of Parliament.</p><p> </p>
