answer text <p>The Legal Aid Agency (LAA) is responsible for commissioning legal aid services in England and Wales. The LAA manages capacity in a number of ways. The LAA’s network of regional contract managers located throughout England and Wales provide intelligence-led information based on contact with legal aid service providers. In addition, the LAA frequently reviews market capacity to make sure there is adequate provision for legal aid, in all categories of law, and moves quickly where issues arise to secure provision.</p><p> </p><p>The commissioning and monitoring of legal aid services are done by Procurement Area or Access Point, with Procurement Areas differing for different categories of law. The commissioning standard is to have at least one provider in each civil category per Procurement Area, outside Family Law where the minimum is five.</p><p> </p><p>Information about the number of legal aid providers contracted to provide services are published as part of the <a href="https://www.gov.uk/government/statistics/legal-aid-statistics-january-to-march-2023/legal-aid-statistics-england-and-wales-bulletin-jan-to-mar-2023#legal-aid-providers" target="_blank">LAA’s statistics</a>. These statistics are used by the LAA as management information to monitor the capacity of legal aid services over time, in different areas of law and different regions of England Wales.</p>

answer text <p>The purpose of review of civil legal aid is to identify evidence-based options for moving to a more effective, efficient and sustainable system for legal aid providers and the people who rely on legal aid.</p><p> </p><p>Whilst the review of civil legal aid is taking place, we are continuing to make improvements across the sector to ensure legal aid is available to those who need it.</p><p> </p><p>We are injecting £10m a year into housing legal aid through upcoming changes to the Housing Possession Court Duty Scheme (HPCDS), to give people the best change of keeping their home when they fall into difficult financial times.</p><p> </p><p>From 1 March 2023, we are broadening the evidence requirements for victims of domestic abuse applying for legal aid. Special Guardianship Orders in private law proceedings will also be brought into the scope of legal aid from 1 May 2023. This will deliver on our commitments to support victims of domestic abuse and allow special guardians to access legal aid. This means an increase in funding of £13m per year.</p><p> </p><p>We are expanding legal aid provision through the Nationality and Borders Act, spending over £8m, aiming to provide advice to individuals who are prioritised for removal from the UK, and to help identify victims of modern slavery.</p><p> </p><p>Legal aid provision is kept under constant review by the Legal Aid Agency, who will take immediate action to ensure there is access across England and Wales.</p>

answer text <p>The requested information can be found in the attachment.</p><p>Data for 2022/23 is a year-to-date figure reflective of the work reported between April 2022 to October 2022, inclusive. Please note that the Legal Aid Agency (LAA) commissions and monitors legal aid services by ‘Procurement Area’ or ‘Access Point’ rather than by local authority. Procurement areas differ for different categories of law.</p><p>The LAA frequently reviews market capacity to make sure there is adequate provision of legal aid, in all categories of law, throughout England and Wales. The LAA moves quickly, where issues arise, to secure additional provision and to ensure demand for legal aid services is met across the country. The LAA contracts with a range of legal aid providers of varying size and capacity to take on new cases. Additionally, legal advice on a range of civil matters including housing, debt, discrimination and education is available, wherever people are, through the Civil Legal Advice telephone service.</p><p>Demand for legal aid services may vary across different categories of law. In particular, there may be low demand for services in categories such as clinical negligence or welfare benefits where the scope of services funded through legal aid was reduced under the Legal Aid Sentencing and Punishment of Offenders Act 2012.</p><p>In early 2023 the LAA will be opening up a tender for new entrants who want to bid for a 2018 civil legal aid contract in all categories.</p><p> </p>

Please note that a single office may have a Contract to deliver services in more than one area of law.</p><p>A civil legal aid provider would only be unable to take on a case where there is a sanction in place prohibiting them from taking on a new matter or case. Sanctions are applied only in limited circumstances, for example, where there has been a material breach of the contract.
