answer text <p>Article 130 of the Withdrawal Agreement provides for the relative stability keys for the allocation of fishing opportunities to be maintained during the implementation period. This provision is intended to ensure that the UK’s share of quota cannot be reduced and that the UK will continue to be able to invoke Hague Preference during the implementation period. The recitals to the basic Common Fisheries Policy Regulation (Regulation 1380/2013) make clear that relative stability should take account of the Hague Resolution and therefore this would be included in the reference to ‘relative stability keys’ in Article 130.</p> more like this

answer text <p>The Government is planning for all scenarios including leaving the EU without a deal. We have published a technical notice on arrangements for UK fisheries should we leave the EU without a withdrawal agreement. UK fisheries administrations would advise UK quota holders what their allocation will be for the remaining months of 2019 after we leave the EU.</p> more like this

answer text <p>The UK does not have a system of auctioning for fishing quotas. UK quota is only allocated to vessels registered and licensed in the UK, but case law established the rights of those in other EU Member States to invest in, or purchase, UK licensed vessels, thereby entitling those with UK registered vessels to obtain UK quota shares.</p><p> </p><p>The economic link conditions currently associated with UK fishing licences were introduced in 1999 to make sure a genuine economic benefit is accrued to the UK from economic activities derived from UK fishing opportunities. We are reviewing the economic link condition as part of the development of our future fisheries management arrangements.</p> more like this

answer text <p>The current historic EU quota shares, fixed through the principle of “Relative Stability”, are unfair to the UK fleet for many stocks. EU vessels currently catch around 700,000 tonnes of fish from UK waters each year. The UK fleet only catches about 100,000 tonnes of fish in EU waters each year. After the end of the Implementation Period, the UK will diverge from the existing allocation methodology for Total Allowable Catches (TACs) and seek a more equitable arrangement as a condition of future access to UK waters.</p><p> </p><p>We are currently giving detailed consideration to fairer allocation methodologies for Total Allowable Catches in future international negotiations. After March 2019, the UK will also join Regional Fisheries Management Organisations such as the North East Atlantic Fisheries Commission in preparation for the UK regaining its seat in international fisheries negotiations from the autumn of 2020.</p><p> </p> more like this

answer text <p>Union vessels using hook and line methods have a directed fishing provision after February and March if they have a verified track record of catches, but it should be noted that bass catches by UK vessels using that method have tended to peak during the summer months from July to September. The Government does not intend to extend the moratorium period that has been agreed at EU level. However, my Department will of course continue to consider any new scientific advice on the state of the bass stock and the need for appropriate conservation measures.</p> more like this

answer text <p>Guidance was initially published by the Marine Management Organisation on 31 January 2017 to assist industry in understanding their obligations and the various requirements in respect of fishing for bass, as set out in Article 9 of Council Regulation (EU) 2017/127. Letters are being sent to all commerical fishermen within England and Wales who, based on their catch track records, have authorisation to catch bass, and to those who do not have such authorisation.</p><p> </p><p>To ensure compliance, the Marine Management Organisation will continue to engage with industry via regionally based staff to raise awareness of the rules, ensuring they are understood and individuals can access the right information easily. Where these rules are broken a proportionate and appropriate approach to enforcement action will be taken.</p> more like this
