answer	answer is ministerial correction date of answer 26/04/2017 answer text <p>We have strengthened Neighbourhood Planning through the Neighbourhood Planning (General) and Development Management Procedure (Amendment) Regulations 2016 that implement powers in the Housing and Planning Act 2016 and proposed measures in the Neighbourhood Planning Bill. In addition, my recent Neighbourhood Planning written ministerial statement of 12 December 2016 further strengthened Neighbourhood Planning by making it clear that where communities have planned for housing in their area through a recent neighbourhood plan, that those relevant policies should not be deemed to be “out-of-date” unless there is a significant lack of land supply for housing in the wider local authority area.</p><p>The Government has made available £22.5 million to support Neighbourhood Planning through the 2015-18 support programme. To support the Government’s approach, the Neighbourhood Planning Bill, which went through Second Reading in Parliament on 10 October, contains measures to further strengthen neighbourhood planning.</p><p>We are also supporting neighbourhood planning through a £22.5 million support programme which has made over 1,500 payments to groups since April 2015. All groups can apply for a grant of up to £9,000. Additional grant and technical support is available to priority groups, including those in urban and more deprived areas. answer	answer is ministerial correction date of answer 13/09/2016 answer text <p>The Neighbourhood Planning Bill will strengthen neighbourhood planning, by requiring local planning authorities and others who decide planning applications to have regard to neighbourhood plans that have been independently examined, once the decision has been taken to put the plan to a referendum.The Bill would also ensure plans have full legal weight at an earlier stage of the process, as soon as the outcome of the referendum is announced, and make it easier to ensure plans can be kept up to date.</p><p>These measures are in addition to existing safeguards that ensure neighbourhood plans are given proper consideration, including existing powers for communities to request that the Secretary of State ‘calls-in’ planning applications for his own determination, and new requirements introduced in the Housing and Planning Act, that will require any conflict with a made neighbourhood plan to be set out in the committee report that will inform a planning committee decision.</p><p>Furthermore, national planning policy is clear that where a planning application conflicts with a neighbourhood plan that has been brought into force, planning permission should not normally be granted, and that decision-makers may give weight to policies in emerging neighbourhood plans according to the stage of preparation of the plan, the extent of unresolved objections, and the degree of consistency with the National Planning Policy Framework.</p><p>In the light of these safeguards, the government does not support a right of appeal for those opposed to a decision to grant planning permission, which would delay the building of the new homes we need.</p> answering member constituency Croydon Central answering member printed Gavin Barwell question first answered 13/09/2016 16:39:25 answering member 3955 label Biography information for Lord Barwell

Reforms in the Housing and Planning Act 2016 will help to speed up and simplify the neighbourhood planning process. We are looking to introduce a new package of measures that would further strengthen the neighbourhood planning process when Parliamentary time allows over the course of the second session.</p><p>The neighbourhood planning legislation means that most challenges to neighbourhood planning decisions need to be brought within six weeks of the decision that is being challenged, rather than three months for most other judicial review proceedings, with no discretion to extend the time limit. This helps ensure that any associated delays are minimal. A local authority’s development proposals, like those of other persons applying for planning permission, must be decided in accordance with the development plan unless material considerations indicate otherwise.</p><p>Once brought into force, a neighbourhood plan becomes part of the development plan for the area; an emerging neighbourhood plan may be a material consideration. The National Planning Policy Framework sets out that the weight of emerging plan policies will depend on the stage of the plan, the extent of unresolved objections and the degree of consistency with national policy.
