answer	answer is ministerial correction date of answer 28/11/2022 answer text <p>Officials from the Department for Business, Energy and Industrial Strategy and the Low Pay Commission (LPC) speak to a wide range of stakeholders in relation to the National Minimum Wage (NMW) and its enforcement.</p><p>Almost all workers in the UK are entitled to be paid at least the NMW. This includes seafarers who ordinarily work within the UK and its territorial waters. answer	answer is ministerial correction date of answer 24/03/2022 answer text <p>The Government is clear that anyone entitled to be paid the minimum wage should receive it. In 2020, the Government legislated to ensure that seafarers who are working in the UK territorial sea are entitled to be paid the minimum wage, regardless of where they ordinarily work or where their ship is registered. This means that most individuals working in our waters are entitled to be paid at least the National Living Wage or relevant National Minimum Wage rate for their age.</p><p> </p><p>An individual’s entitlement to the minimum wage is not dependent on the rates of pay included in a job advert or job offer that they accepted. If an individual is not being paid at least minimum wage when they are entitled to it, they should complain to HMRC using the online form on GOV.UK. answer	answer is ministerial correction date of answer 29/03/2022 answer text <p>Seafarers who ordinarily work within the UK and its territorial waters are entitled to be paid the UK National Minimum Wage.</p><p> </p><p>The government is clear that anyone entitled to be paid the minimum wage should receive it and takes robust enforcement action against employers who do not pay their staff correctly. HMRC enforce the minimum wage on behalf of the government, across all sectors of the economy. They consider every complaint from workers, conduct proactive enforcement activities, and deliver educational activity to support employer compliance. HMRC have a strong record on enforcing the minimum wage. Since 2015 they have returned over £100 million in unpaid wages to 1 million workers.</p><p> </p><p>If anyone thinks they have been underpaid, they should complain to HMRC using the online form on GOV.UK, or call the Acas helpline. answer	answer is ministerial correction date of answer 22/02/2021 answer text <p>On 1 October 2020, the Government passed the National Minimum Wage (Offshore Employment) (Amendment) Order 2020 that extended the NMW to include an individual who ordinarily works in the territorial waters of the United Kingdom or in the United Kingdom section of the continental shelf.</p><p>The Government’s “Calculating the Minimum Wage” guidance has been updated to take account of these changes and can be found at <a href="https://www.gov.uk/government/publications/calculating-the-minimum-wage/calculating-the-minimum-wage#seafarers" target="_blank">https://www.gov.uk/government/publications/calculating-the-minimum-wage/calculating-the-minimum-wage#seafarers</a>.</p><p>We are currently drafting further guidance on this issue for employers and seafarers. answer	answer is ministerial correction date of answer 18/06/2019 answer text <p>Enforcement of the National Minimum Wage is a priority for the Government. Since 2015, we have doubled the budget to enforce the NMW and in 2018/19 HM Revenue &amp; Customs identified a record £24.4 million in arrears for over 220,000 workers.</p><p> </p><p>HMRC takes a risk-based approach to enforcement, which means they can flex their resources to tackle an emerging threat or issue, including for seafarers working in the shipping industry.
