answer text <p>Earlier this year, in the Government’s response to the Taylor Review of Modern Working Practices, we accepted the review’s recommendation to ask the Low Pay Commission (LPC) to explore the impacts of introducing a higher National Minimum Wage rate for hours that are not guaranteed as part of a contract. Furthermore, we asked the LPC to provide advice on the impacts of alternative options for tackling the issue of one-sided flexibility.</p><p> </p><p>We await the LPC’s assessment of these options.</p> more like this

answer text <p>The Government is committed to fair pay by ensuring workers are paid at least the National Minimum Wage (NMW). In 2017/18, HMRC secured a record volume of pay arrears (£15.6 million) for a record number of workers (201,800).</p><p> </p><p>In 2018/19, we have increased the enforcement budget for the NMW to £26.3 million. This additional resource will allow HMRC to proactively target those employers judged most at risk of not paying the minimum wage. As part of this, we will spend £1.48 million raising awareness of workers’ entitlement to the NMW.</p><p> </p><p>Employers found to be breaking the rules could face penalties of 200% of arrears owed to the worker to a maximum of £20,000 per worker. Anyone concerned they are being underpaid should call the Advisory, Conciliation and Arbitration Service (Acas) Helpline (on 0300 123 1100) for free and confidential advice. HMRC respond to 100% of complaints made.</p> more like this

answer text <p>In April 2017, the Annual Survey of Hours and Earnings (ASHE) produced by the Office for National Statistics estimates there were 342,000 jobs with pay less than the National Minimum Wage (NMW) and National Living Wage (NLW) held by employees aged 16 and over, this constitutes 1.2% of all UK employee jobs. This represents a slight decrease from 365,000 jobs (1.3%) in 2016. Further information is published on the ONS website (copy attached), including important caveats in interpreting the data.</p><p> </p><p>The Government is committed to increasing compliance with the minimum wage. We are clear that anyone entitled to be paid the minimum wage should receive it. We have more than doubled the enforcement budget for the NMW and NLW to £26.3 million for 2018/19, up from £13 million in 2015/16. answer text <p>National Minimum Wage legislation provides that, if an individual is a “worker” for minimum wage purposes, he or she must be paid at least the national minimum or living wage. Short unpaid trials are permissible if they are part of a genuine recruitment exercise.</p><p> </p><p>HM Revenue and Customs take action against employers attempting to exploit workers by not complying with minimum wage legislation. They respond to all complaints and assess the facts of each case. Where they come to the view that unpaid work trials are in fact “work” under National Minimum Wage legislation, they will require the employer to pay any arrears to the worker and to pay a fine of up to 200% of the arrears.</p><p> </p><p>The Government’s policy is that it is unacceptable to exploit workers through excessively long unpaid work trials. We are therefore preparing guidance that will bring clarity on the responsibility of employers to pay the National Minimum Wage. We will work with key business and worker stakeholders in developing that guidance.</p><p> </p>

answer text <p>The Government takes robust enforcement action against employers who do not pay their staff in accordance with the National Minimum Wage (NMW) regulations. The budget for enforcing the National Minimum and Living Wage has increased from £13.2 million in 2015/16 to £25.3 million for 2017/18, leading to an increase in the number of compliance officers available to investigate abuses.</p><p>The penalty regime has been significantly strengthened in recent years; in 2016 the financial penalty was increased to 200% of arrears. We have also changed the penalty cap to apply on a ‘per worker’ rather than ‘per employer’ basis; this means that employers who break the law face a maximum penalty up to £20,000 maximum per worker.</p><p>To further deter employers from underpaying their staff, BEIS runs an NMW public naming scheme, publishing a quarterly list of employers who have failed to pay their staff the NMW.</p><p> </p> more like this

answer text <p>HM Revenue and Customs (HMRC) is responsible for ensuring that employers comply with National Minimum Wage (NMW) regulations. The Government has increased its enforcement budget to £25.3 million for 2017/18, up from £13.2 million in 2015/16.</p><p>HMRC conducts risk-based enforcement in sectors or areas where there is perceived to be a higher risk of workers not getting paid the legal minimum wage. It also considers every worker complaint received and has set up a dedicated team focused on tackling the most serious cases of wilful non-compliance.</p><p>Since HMRC began enforcing the minimum wage in April 1999, it has identified almost £79 million in arrears. In 2016/17, HMRC took action against 1,134 businesses, identifying £10.9 million for 98,000 workers who had been illegally underpaid.</p><p>The Government has increased the deterrence against non-compliance, increasing penalties from 100% to 200% of the arrears owed, up to £20,000 maximum per worker and revising the naming criteria, with over 1,500 non-compliant employers named to date.</p><p>In January, the Government appointed Sir David Metcalfe as the first Director of Labour Market Enforcement. He is responsible for producing an annual strategy setting the strategic direction of the three existing labour market enforcement bodies, HMRC’s NMW team, to ensure that enforcement efforts are coordinated and targeted.</p>
