unstar this property answer text <p /> <p>No actuarial calculations were carried out in relation to the payments that would be made by the Diffuse Mesothelioma Payment Scheme. The tariff table, which sets out the rate of payment according to age at diagnosis, is based on an average of similar payments made under civil compensation.</p><p> </p><p>The Impact Assessment published in March 2014 estimated that £93.7m would be paid out by the Scheme in the first year of its operation, and £412.4m would be paid out over the first 10 years.</p><p> </p><p>Initial application volumes were lower than anticipated so the amount levied on the insurance industry for the period 2014/15 was £32m. It is too early to estimate what the application volumes will be over the next 10 years given volumes received to date. As this is a demand led scheme, the calculations for the levy are done afresh each year. An upturn in applications to the Scheme would result in a higher levy rate in future years.</p> more like this

unstar this property answer text <p>When the Diffuse Mesothelioma Payment Scheme (DMPS) was introduced in 2014 the payment tariffs were based on 80 percent of the average damages awarded in the civil courts. This amount was increased to 100 percent in 2015</p><p>This increase is far greater than if increases had been made in line with the Consumer Price Index (CPI). For example, the highest DMPS payment for those aged 40 or under in 2014 was £216,896 and this was increased to £271,120 in 2015, and the lowest payment for those aged 90 or over increased from £69,649 to £87,061</p><p> </p><p>Information about the value of court awards or out of court settlements in Diffuse Mesothelioma cases in the past three years is not available. The <a href="https://assets.publishing.service.gov.uk/government/uploads/system/uploads/attachment_data/file/269880/research-report-858.pdf" target="_blank">'Study into average civil compensation in mesothelioma cases'</a>, published in 2014, estimated average (mean) civil compensation at £153,531 (in 2012 prices). The average payment under the DMPS for each of the last three years is £135,000, £141,000 and £145,000 respectively.</p><p> </p><p>In line with commitments made during the passage of the Mesothelioma Bill, the intention is to review the payment tariffs, in due course, to ensure payments made under the Scheme are maintained at the appropriate level.</p>

unstar this property answer text <p /> <p>A person with diffuse mesothelioma, or their dependents, may be eligible to apply for the Diffuse Mesothelioma Payment Scheme (DMPS) if no one has received damages or a specified payment in respect of the disease or is eligible to receive a specified payment from another source.</p><p> </p><p>Eligibility for, or receipt of, such payments disqualifies an applicant from receiving a DMPS payment. This prevents a person receiving more than one payment for the same condition and ensures that all claimants are treated fairly and with equity.</p><p> </p><p>These specified payments include payments under the Turner and Newall Trusts.</p> more like this

unstar this property answer text <p /> <p>The Scheme began taking applications in April 2014, and began making payments on 1 July 2014. As of 30 September 2014 the Scheme had received 173 applications. During the first year of operation we had forecasted around 900 applications to the Scheme.</p><p> </p><p>The DMPS is funded by a levy on the insurance industry. The levy is intended to cover the cost of the Scheme in any one year, and we are not expecting to generate any under spend. Any under spend would be returned to HM Treasury.</p><p> </p> more like this

In 2015/16 a total of £29.7m was paid to successful applicants. 2016/17 is not yet calculated.</p><p> </p><p>3) The difference between the sum raised through the levy and the amount paid out to applicants in compensation is used in one of the following ways:</p><ul><li>To repay as compensation recoveries (the amount is determined by the Department’s Compensation Recovery Unit);</li><li>To pay a scheme administrator;</li><li>Any balance is accounted for as either an under or over levy for successive year’s estimated levy amount.</li></ul>
